20 minutes – Otto’s takes away the Swiss cross at On-Schuh

Otto’s has a lot to do at the moment. The discounter must remove or make the Swiss cross unrecognizable on hundreds of On brand sneakers. Depending on the shoe model, Otto’s paints the flag or cuts it out, as Otto’s spokeswoman Angela Schnyder says to 20 minutes. Otto’s is discreet and make sure that the shoes will not be damaged. Then they should go back to the shop “absolutely intact”.

The work is necessary because Otto’s imported the on shoes past the official Swiss sales channel from abroad, where the sneakers have the Swiss cross. In Switzerland, however, the logo is not allowed because On has the shoes produced in Vietnam. Products with a Swiss cross or similar may only be sold in Switzerland in accordance with the Swissness Act if 60 percent of the manufacturing costs are incurred in Switzerland.

After a first 20-minute report on the On shoes at the dumping price, Otto’s mistake admitted. The discounter received the goods partly with and partly without flags. Therefore, the company did not notice the problem at first.

By selling the shoes with a Swiss cross, Otto’s may have violated the trademark protection law. Commercial perpetrators face a fine and up to five years in prison if they violate the law. The Swiss Federal Institute of Intellectual Property (IPI) is in contact with Otto’s, as David Starkkle from IPI Legal Service said in 20 minutes.

On did not want to comment on the matter with the shoes at the dumping price on request of 20 minutes. The discounter Otto’s is currently selling a shoe model for CHF 149 instead of CHF 210. Due to the high demand, certain sizes were quickly sold out, but Otto’s has announced replenishments.
