NEW YORK – New York City will have to pay more than half a million dollars to a Queens man who said he was subjected to an illegal chokehold by a NYPD officer and subjected to electric shocks multiple times in 2018.
The city’s legal department confirmed Wednesday that it will pay $ 562,500 to Tomás Medina and former detective Fabio Núñez, who was seen in a video suffocating Medina, will pay $ 5,000 out of his own pocket. The department declined to comment further on the deal.
Núñez and another NYPD officer responded to an alleged noise complaint in Inwood on July 14, 2018. That’s where Núñez met Medina and placed him in a headlock, which at the time was prohibited by the police department and is now illegal under city and state laws. , and shook it with shocks 13 times, according to Legal Aid Society.
Medina subsequently filed a complaint with the Civil Complaints Review Board and the board overnight corroborated his claims. However, Núñez was not tried on charges of excessive force because he accepted an agreement that would have taken away 30 days of vacation and would have put him on probation for dismissal for a year, reported the NY Daily News.
Núñez began working for the NYPD in 2000, before retiring in April 2021, and has been mentioned in several lawsuits for use of excessive force or other misconduct, some of which the city also paid thousands of dollars in agreements.
According to CCRB data, there were a total of 17 complaints and 10 complaints against Núñez over the years. The board confirmed three of those allegations.
