The Supreme Administrative Court overturned a deed for withdrawing a total of BGN 328,887,932.92 from “Eurofootball”, one of the companies of defendant Vasil Bozhkov, the court announced. It was imposed by the State Gambling Commission.
The company challenged the deed, but the chairman of the commission rejected the appeal. However, it was he who issued the deed. Therefore, the court canceled the document. “However, it is legally inadmissible that the same body is authorized to issue the act at the same time as it has the competence to issue a decision in the event of an administrative dispute”, write the supreme magistrates. They do not decide on the dispute over the amounts due.
“The nullity of the act was declared for clear violations of the procedure by which the claim of the public state was founded”, added the court.
