Court rejects teachers request to suspend vaccine mandate

Supreme Court Justice Sonia Sotomayor decided not to block the New York City mandate that education employees – teachers and others – be vaccinated by Friday night.

The judge, in charge of urgent matters of the Court – something in which the different judges take turns -, resolved on her own the request that a group of New York professors had made for the Court to intervene against the mandate.

The NYC mandate to get vaccinated was 5 pm on Friday.

The NY Department of Education had previously reported that the mandate was still in force and that whoever had not shown proof of vaccination would be suspended without pay starting next Monday.

The attorney for the teachers who made the petition to the Court noted that they were “deeply disappointed” with the Supreme Court’s decision and that the voices of “our teachers deserve to be heard.”

The lawyer adds that the vaccination mandate in general is an “unconstitutional edict” that has not been litigated in court “for more than a century.”

“Our children are the ones who will suffer the most,” said the lawyer. The teachers our children appreciate so much “will not be in the classroom,” he added.

According to Mayor Bill de Blasio, 90% of education employees have been vaccinated, 93% of teachers and 98% of school principals.

Teachers and employees who have not been vaccinated can do so even after the Friday deadline and if they insert the test online with the Education department they will be activated again so that they do not lose their salary on Monday.
