Tears of excitement, excitement and gratitude to God spread yesterday at the New Palace of Justice, from the moment a representative of the public ministry informed Judge Vladimir Rosario García that they were ordering freedom, pure and simple, of Colonel Ramón Antonio Guzmán Peralta, and Claro’s technician, Manuel Regalado, who were arrested for their alleged connection with the sabotage of the suspended elections of February 16.

At the time the public prosecutor announced the decision, in hearing, the judge of the ninth criminal chamber of the National District was going to give his verdict on a request for declination, due to the court’s incompetence, presented by the prosecutors, on an action of habeas corpus brought by the colonel, alleging illegality of the prison.

When he left the courtroom, Colonel Guzmán Peralta was silent, and his lawyer, Antoliano Peralta, pointed out that being a National Police officer, he could only speak with permission from his superiors.

His sister, Cruz Guzmán, expressed satisfaction with the release and thanked God, because he never abandoned them.

Illegal prison

Prior to ordering the freedom of the two defendants, the public prosecutor had asked the judge to decline the habeas corpus action to the Superior Electoral Tribunal (TSE), as it was a case of electoral crime, but the magistrate did not decide on that request.

The colonel’s lawyer, Antoliano Peralta had opposed the declination, because he considered that the crimes reported are alien to the electoral process.

Prior to his release, the clearing technician had also filed a habeas corpus action, but before the Superior Electoral Tribunal (TSE).

Human rights

The president of the National Human Rights Commission, Manuel María Mercedes, went to the Court to demand the release of the colonel and the technician, who he considers are innocent, while denouncing that the prison was illegal.

“We hold both President Danilo Medina and Attorney Jean Alain Rodríguez responsible for using these two people as scapegoats in order to hide the true perpetrators of the events that occurred on February 16, with the intent of perpetrating electoral fraud,” he said. María Mercedes, Human Rights leader.
