This was said by Stefana Elisavetova, mother of 18-year-old Bobby – one of those killed in Novi Iskar on New Year’s Eve 2017. The woman won at the first instance in the Sofia City Court (SGC) a case for compensation of BGN 160 thousand from the prosecutor’s office, which

The bloody action takes place in a house in Novi Iskar. To welcome 2018, Nedelcho Yunakov, 41 years old, his girlfriend Keti Kyukhova, mother Elenka Burdzhieva and 16-year-old daughter Nancy with her 18-year-old friend Bobby, as well as Nedelcho’s son – Georgi, 20, have gathered .

Students Bobby and Nancy hear the gunfire and try to hide upstairs. Angelov discovers them too and kills them with a Beretta. The killer collects the shell casings, tries to clean the house and cover up the crime by moving the bodies and stacking them on top of each other.

None of the neighbors heard the gunshots on New Year’s Eve because of the roar of firecrackers and fireworks and the homemade silencer.

Angelov was found in an abandoned house in the village of Lukovo

on January 7. They found him after a large-scale search, shot in bed, and next to him was a tablet from which he had been watching child porn.

Rosen was wanted years ago and should have been in jail at the time. He is a repeat offender with several convictions. One of them is for rape from 1998.

His last sentence of 8 years in prison for fornication with an 11-year-old child came into effect on December 22, 2009. However, he never went behind bars because he skillfully hid. That’s why we got to the shocking six murders in the first minutes of 2018.

After Gorski’s sentence came into force, the prosecutor’s office sent the request for Angelov’s detention to the “Security” unit 22 days later – on January 14, 2010. Five days later, he was searched at the given address but was not found. He was declared wanted, and on June 22, 2015, it was for him

European arrest warrant issued

“First, we brought an extrajudicial claim to the prosecutor’s office because it did not conscientiously and fully, but formally, fulfill its obligations to ensure the execution of the sentence,” commented Stefana Elisavetova’s lawyer Nikolay Dimitrov.

He explains that they then filed a case with the SGS for compensation.

“Now, although at first instance, the court has recognized that there is a lack of purposeful, timely, consistent and acceptable actions on the execution of the sentence”, adds lawyer Dimitrov.

He clarifies that the prosecutor ensures the final execution of the sentences, although the specific actions are carried out by the services of the ministries of justice and the interior.

“The search for Angelov has been formally approached

When the Ministry of Internal Affairs sent information that they were unable to find him, the prosecutor’s office should have given specific instructions for the search. This has not been done”, clarifies Dimitrov.

For its part, the prosecution claims that there is no causal connection between Angelov’s hiding and the subsequent six-part murder. She has fulfilled her duties and all necessary actions have been taken to execute the sentence with instructions to detain the convict.

Periodic control of search operations was also carried out.

There was no guarantee that if Angelov had gone to prison, he would not have committed the murders, because he could have been released early. However, the court believes that since he was not detained and put behind bars, there was no opportunity to fulfill the goals of the punishment – the correction and re-education, so that he does not commit other crimes.

Thus, the magistrates believe that there is a causal connection between the non-execution of the sentence and the murder of six.

At first instance, the prosecutor’s office was ordered to pay BGN 160,000 to Bobby’s mother for moral damages from the boy’s death.

“We will submit a request to the general prosecutor to seek criminal responsibility from the prosecutor,

who has not done his best. This is non-fulfillment of obligations and inaction, and there is personal guilt,” Dimitrov claims.

“Money is not my goal. However, let the state do everything possible so that everyone convicted is in prison. I’m already half a person – I take a handful of pills, I don’t sleep for whole nights”, cries mother Stefana.

A similar claim to the court was brought by Ivo Kyukhov – son of Elenka Burdzhieva, brother of Keti and uncle of Nancy. He requested compensation from the prosecutor’s office for not ensuring the execution of Angelov’s previous sentence.

At two instances, the court accepted his arguments and awarded BGN 50,000 compensation for the death of his mother and BGN 30,000 for his sister. Magistrates accepted that he had not provided sufficient evidence of a particularly close relationship with his niece Nancy and refused compensation for her death.

The case of Ivo Kyukhov is currently at the last instance in the Supreme Court and there is no final decision.
