In Kiel, a woman sits in the dock who is said to have killed her own mother. An appraiser had classified the woman as “dangerous” – her lawyer, however, sees it differently.
A 54-year-old woman who is said to have suffocated her needy mother is to be placed permanently in the forensic psychiatry at the request of the public prosecutor. The “further actions to be expected from her are so serious that she has to be accommodated,” said prosecutor Gesine Ohst on Monday.
The psychiatric expert had previously classified the addicted woman as dangerous for the general public. He did not rule out that she was completely incapable of guilt at the time of the offense in December 2020. Due to her condition, she was incapable of negotiating and interrogating, said the expert at the Kiel regional court.
Woman not able to be heard
The woman takes part in the process, but according to her defense counsel, she is unable to grasp the content of questions and answer them accordingly. Attorney Axel Höper said that the inability to interrogate was a “permanent procedural obstacle”. He therefore applied for the proceedings to be discontinued before a criminal court. In contrast to the prosecutor and appraiser, he assumed that the act was related solely to the mother. He does not see any danger to others because of this.
According to witness statements, the daughter was already waiting for the mother on the day of the incident, who was brought home from the nursing home that evening. She dragged the scared 83-year-old into the apartment. There she is said to have brought the elderly woman to the ground, sat on her and covered her mouth and nose. The woman suffocated. Resuscitation fails. The verdict is expected on Wednesday.
