A new corona ordinance is regularly issued in BW. For some time now, these have been designed for four weeks. But why is it like that? And how does such a regulation come about?
At the beginning of the corona pandemic, there were no overly strict guidelines in Germany about how long infection protection measures were allowed to apply and how they should be controlled. The state government in particular could have issued ordinances on infection protection that would have remained in force for months without the state parliament having to pass a resolution. In order to ensure more transparency and tighten parliamentary control over the corona measures, the Bundestag and Landtag have changed the legal rules in recent months.
New corona measures are limited in time
According to the Federal Civil Protection Act, the following applies today: Statutory ordinances of the state governments on corona measures must always be justified in detail and are generally limited to four weeks. According to the state law (law on the enactment of infection protection measures) it is regulated that the state parliament is informed immediately of every new corona ordinance. The MPs should be able to discuss this publicly. If an ordinance is to remain in force beyond a period of four weeks, the state parliament must give its approval in any case.

The current Corona regulation in Baden-Württemberg has been in force since September 16. It normally expires after four weeks, on October 14th. This is what is already announced in the text of the regulation. Should the situation change dramatically, it is of course possible at any time to initiate a new regulation beforehand. Otherwise, the state government has four weeks to check which new regulations are possible. For example, it is currently under discussion whether the mask requirement should be lifted in the classrooms of schools or whether stadiums can in principle be fully occupied again if the 2G rule applies there.
This is how a new corona regulation is created
Such questions are then discussed, for example, by lawyers from the various state ministries and experts from the state health office. In addition, new agreements between the federal and state governments may have to be taken into account. From all of this, the text for the next Corona regulation will be created in the State Ministry. The closer you get to the deadline on which the current regulation expires, the more time is pressing. After all, all members of the state government still have to agree to the text – and it should be published as early as possible. So a few days before the previous regulation expires. Because that enables everyone to adjust to new requirements. In the past few months, however, this has often not worked. Because legal details are sometimes being worked on until the very end, it happens again and again that the final text of a new Corona regulation in Baden-Württemberg is only known one or two days in advance.
