According to the investigation, on October 27, 2019, the man was at home with three children. Around 11 pm, he called his wife, who was at work, and said that the youngest daughter began to bleed. The child was taken to the local Central Hospital, where she was examined by a gynecologist and found injuries that spoke of violence. A case was opened against a man under article 132 of the Criminal Code of the Russian Federation (“Violent acts of a sexual nature against a person under the age of 14”). During the investigation, the father claimed that he wanted to change the diaper for his daughter, but accidentally injured her. He later admitted that he was very angry with his wife and thus decided to take revenge on her. “Just freaked out,” he said in court
The court considered that the defendant did not have a desire to satisfy sexual needs, which means that there was no corpus delicti in his actions. The man was completely acquitted and released.
“There was a lot of evidence that the defendant acted with direct intent. These are the testimonies of both the mother of the child and the ambulance paramedic who arrived to call on the injured girl, and finally, the testimony of the accused. Although not immediately, he confessed that allegedly “out of spite” he had committed violence against his daughter. During the investigation, a forensic medical examination was carried out, an expert was questioned in court, who confirmed the possibility of injuring the girl’s organs in the manner announced by the defendant himself. Such injuries in a random way cannot be inflicted. In addition, the court did not assess the fact that the girl was also slightly injured in her health. And the background of the reason why this was done, does it really matter? Naturally, in the end, we did not agree with the decision of the Bugulma City Court and filed an appeal to the Supreme Court of the Republic of Tatarstan, ”said Nikolai Vdovin, deputy of the Bugulma city prosecutor.
