The Public Prosecution Service in Poland no longer wants to surrender suspects to the Netherlands, so reports NRC Monday on the basis of a letter in their hands. It is said to be a reaction to the decision of the International Legal Assistance Chamber (IRK) of the Amsterdam District Court to stop surrender to Poland.
In an internal letter to all Polish prosecutors, the country’s highest prosecutor, Bogdan Swieczkowski, writes that he does not want any more suspects or convicts to be handed over.
In the letter he writes that the Netherlands “fails to respect the principle of mutual trust”. With that he seems to be responding to the decision of the IRK this summer to suspend the transfer of Polish suspects.
According to the IRK, Polish courts can no longer function independently. The IRK – which decides on the surrender of suspects and convicts to other European countries – refused to surrender a drug-trafficking suspected Pole at the end of July because a fair trial could not be guaranteed in his home country.
Case law in Poland has been controversial for some time. According to the IRK, there is political interference in the appointments and transfers of presidents and vice-presidents to judicial authorities and judges.
