After being charged as the alleged perpetrator of the pellet shots that blinded Gustavo Gatica, the Seventh Guarantee Court of Santiago decreed the preventive detention for the lieutenant colonel of the Carabineros, Claudio Crespo, last Friday.

In this regard, the former prosecutor and attorney for the victim, Carlos Gajardo, valued the court’s determination; However, he was critical of the collaboration that Carabineros had in the case.

This is because the lawyer pointed to “notable deficiencies” in the investigation mechanisms, pointing particularly to the institution’s report that did not rule out that the injuries to Gatica were caused by protesters and that neither did he mention the presence of the ex-uniformed person in the act.


The spokeswoman for the Coordinator of Ocular Trauma Victims, Marta Valdés, said that Crespo’s preventive detention opens the possibility for other affected people to access reparatory justice, which, according to the Human Rights Institute, reaches 460 people.

However, he accused a slowness on the part of the authorities to establish responsibilities in these cases.

Criminal lawyer Silvio Cuneo, meanwhile, affirmed that there are political responsibilities and that of the Judicial Power that would have influenced the actions of the Carabineros during the so-called social outbreak.

According to the Seventh Guarantee Court of Santiago, Lieutenant Colonel Claudio Crespo risks a 10-year prison sentence if convicted in the case of Gustavo Gatica.
