NEW YORK – The lawyers of the Mexican drug trafficker Joaquín “El Chapo” Guzmán presented arguments on Monday to appeal his conviction and that he be granted a new trial in relation to the case for which he is serving a life sentence in a Colorado prison.
Guzmán’s attorneys made their arguments before the Court of Appeals for the Second Circuit. A panel of three judges heard the appeal of “El Chapo’s” lawyers.
The lawyers said, among other things, that the days that Guzmán was detained in isolation prior to his trial generated “cognitive impairment” that made the accused unable to participate “fully” in his defense.
In addition, the legal team of “El Chapo” assured that many of the evidence presented in the original trial is invalid. They also cited reports that before convicting him, some jurors accessed newspaper reports about allegations of sexual abuse that were excluded from the process.
The New York Eastern District Attorney’s Office, for its part, said the “Vice” magazine article that the defense cites for your appeal contains false information.
According to the appeal, “the prosecution of Chapo Guzmán was altered by excesses and excesses, both governmental and judicial, unnecessary resources if he were really a capo de capos as his opponents insisted.”
At the trial in July 2019, Guzmán’s lawyers argued that he served as a scapegoat for other drug traffickers who knew how to bribe Mexican politicians and police chiefs to protect them.
The 64-year-old kingpin was sentenced in a New York federal court in 2019 to life in prison on drug-related charges as the leader of the Sinaloa Cartel, and is currently serving his sentence in a maximum security prison in Florence, Colorado.
