Domestic violence: an agreement to facilitate complaints in health establishments

A new important step has been taken to allow women victims of violence to be protected and supported in their efforts.

An agreement intended to facilitate and improve the filing of complaints by victims of domestic and domestic violence, within health establishments, was signed by various partners (health, justice and security), this Wednesday, March 16, at the prefecture of Eure-et-Loir, in Chartres.

Françoise Souliman, prefect of Eure-et-Loir, Rémi Coutin, public prosecutor of Chartres, and Denis Gelez, territorial director of the ARS (Regional Health Agency) presented the main axes of this agreement.

“This is a document that we hold very dear,” says Françoise Souliman. This file took some time to complete due to the Covid crisis. The fight against domestic violence is a daily battle and this help from all health professionals is essential for us in this difficult path. »

What does this agreement actually consist of, which determines a legal framework for all the players? Rémi Coutin details:

“There are two main components. The idea is to ensure that victims of domestic violence, who come to hospitals without first going through the police or gendarmerie, are encouraged as much as possible by the welcome they receive from all hospital staff to file a complaint. This in particular thanks to a form called “simplified complaint filing” and by facilitating their contact with the police or the gendarmerie, very involved in the accompaniment. »

The other part concerns liberal doctors: “Doctors are reminded that there is now an exception to medical secrecy. When a victim of domestic violence comes to their office, private doctors can bring these facts to the attention of the security forces and the justice system, for treatment. »

“Training health workers”

Sara Benzohra, assistant public prosecutor specializing in the field of domestic violence, adds: “The heart of this agreement is the establishment of a protocol which allows complaints to be taken in hospitals and in medical offices. This avoids the victims having to go to the police station or the gendarmerie. This agreement also provides for the training of health personnel in these subjects. For example, regarding the medical certificate, an offense is different, and the penalties incurred also, depending on the duration of an ITT (Temporary Incapacity for Work). »

For Denis Gelez, territorial director of the ARS, “this agreement is the result of many discussions and exchanges. It provides a framework that can be further strengthened in the future. »
