7 Reasons Workers Reject Omnibus Law: Severance Pay and Leave Rights

A number of points in the Omnibus Law Copyright Act (RUU)Ciptaker) which will be ratified by the DPR at the Plenary Session in the near future is considered to be detrimental to workers.

Previously, the Council and the Government approved this bill in the Level I Decision Making Meeting at the DPR on Saturday (3/10) night. Various controversial provisions that harm the people also color it.

Various protests and actions emerged as a reaction to this agreement, one of which was from the workers in the country. They will even go on a national strike if the agreement on the Ciptaker Bill continues to be discussed and will be promulgated into law.


In fact, it is said that as many as two million workers from around 10 thousand companies in 25 provinces will carry out national strikes located within their respective companies.

The Confederation of Indonesian Workers Unions (KSPI) also explained the reasons why several points in the Ciptaker Bill should be highlighted and then rejected because it was considered detrimental to workers.

First, the Ciptaker Bill eliminates the conditional city / regency minimum wage (UMK) and the city / district sectoral minimum wage (UMSK). Meanwhile, the KSPI assessed that the UMK did not need to be given conditions because the UMK value set in each city / district was different.

Supposedly, said the worker, the determination of the increase in value and the type of industry that received UMSK was done at the national level.

Second, cutting severance pay from 32 months of wages to 25 months, in which 19 months are paid by employers and six months are paid by BPJS Ketenagakerjaan.

Third, a certain time work agreement (PKWT) which states there is no time limit for a contract or a lifetime contract.

Fourth, contract employees and outsourcing for life, which according to KSPI will become a serious problem for workers. Because it is still unclear who will pay the Job Loss Guarantee (JKP) for contract and outsourcing employees.

Fifth, exploitative or unlimited working hours are considered to be detrimental to the workers’ physical and physical time.

Sixth, the elimination of the right to leave and wage rights to leave. This protest was also delivered by the National Commission for Women (Komnas), which stated that one of the articles in the labor cluster stated clearly that companies do not have an obligation to pay wages for female workers who take full menstrual leave.

Seventh, there is the threat of loss of pension and health insurance due to a lifetime contract.

In the discussion of this Controversial Bill, as many as seven factions agreed to continue the discussion of the Ciptaker Omnibus Law Bill at the DPR RI Plenary Meeting on Thursday (8/10), while two other factions refused.

Meanwhile, the seven factions that approved this bill were discussed at the next level, namely PDIP, Gerindra, Golkar, PKB, Nasdem, PAN and PPP. Meanwhile, the two factions that rejected the ratification of the Ciptaker Bill were the Democrat Party and PKS.
