There was a patent “for the post office”, will it be “for a fish”? It may turn out that taking fish to the warehouse is enough for trading on Sundays.

The deputies started to close the legal trash, which is the act on restricting trade on Sundays. The amendment is dealt with by the Parliamentary Committee for Social Policy and Family, and experts from the Legislative Office warn against leaving another wicket. There was a patent “for the post office”, will it be “for a fish”?

MEPs are working to tighten the trade ban, because the act on Sunday trade restriction has become a fiction. Life has shown again that imprecise provisions or too many exceptions are an opportunity for creative entrepreneurs. The exclusion was to allow the work of Poczta Polska points on duty, and it became an emergency exit for commercial networks. The post office in the store has become the same as advertising non-alcoholic beer in the media. There, too, “winked” at the client.

Yesterday at the session of the parliamentary committee, a PiS MP Janusz Śniadek he proposed an amendment that will extend the vacatio legis from 14 days to three months, thanks to which post offices on Sundays will be able to operate for a few more months.

– In practice, this means that the ban on Sunday trading until the end of 2021 – or even a little longer – will apply only on paper. Even if the Sejm passed the sealing bill this week (the session will last until September 17) or at the next session (September 29-30), the Senate will still have 30 days to amend the bill or reject the bill in its entirety – both would result in the necessity to further votes in the Sejm. The amended law may leave parliament in the middle or at the end of October, in such a variant it would enter into force in the second half of January, and maybe even in February – he informed portal wiadomoscihandlowe.pl.
Work is underway, and experts z Legislative Office are already warning against leaving another wicket. This time related to the trade in fish. According to the portal Wiadomościhandlowe.pl, while working on one seal, parliamentarians may miss another gap. The deputies focused on the activities of post offices, and they are only one of the 30 exceptions in the act. Another issue is … the trade in fish.

It turns out that today, fishing farms or commercial establishments that receive and trade fishery and aquaculture products can trade on Sundays. MEPs want to remove the last part of the law on trade. Experts quoted by the portal Komunikoscihandlowe.pl point out, however, that leaving the provision on commercial establishments dealing with “receipt of fishery products” unchanged will introduce doubts in interpretation. It may turn out that taking fish to the warehouse is enough for trading on Sundays.

In the end, the deputies did not take into account the remarks of the Legislative Office. The second reading of the bill in the Sejm is scheduled for Thursday.
