The Pitfalls of Advertising Claims: Recent Warnings to Retailers of Food and Nutritional Supplements

Selling food and nutritional supplements is not always easy. Because what statements can be made is strictly regulated. And so this week some retailers fell into the warning trap.

Advertising claims for organic tea

Tea was offered in an online shop that promised a whole range of effects. It was said that the tea contributed to relaxation. Mugwort, raspberry leaves and basil are also said to help promote ovulation. It also said, “Basil is also said to increase sexual desire” and “Yarrow is said to be beneficial for the implantation of the egg in the uterus.”

The Association of Social Competition saw several violations of the law in the advertising statements. On the one hand, the association saw inadmissible disease-related advertising and thus a violation of the Food Information Ordinance. In addition, these are health-related statements that could violate the Health Claims Regulation.

If these regulations are violated, there is usually also a violation of competition law. The association asserted this here and charged the company warning costs amounting to 238 euros.

Another online retailer has received a warning from the Association of Social Competition. Once again it was about health-related advertising claims. Here the dealer sold nutritional supplements in the form of capsules in his eBay shop. The item description then said that the capsules support the immune system and that it is a remedy.

The association complained that advertising was made with exaggerated and by no means proven effectiveness claims and then warned the retailer.

Banned ingredients in cosmetics

Attorney Sandhage also sent warnings again. This time it hit a cosmetic product dealer. This sold products that contained the ingredient pyrithione zinc. This ingredient is banned in cosmetics in the EU. The violation of a consumer protection standard also constituted a violation of competition law, which was warned.
