Attorney General’s Office (Attorney General’s Office) fully supports the death penalty given by the panel of judges to the former Kadiv Propam Polri Freddy Sambo.
Kapuspenkum Attorney General’s Office Ketut Sumedana assessed that the decision against the accused in the premeditated murder of Brigadier Nofriansyah Yosua Hutabarat was in accordance with the considerations of the Public Prosecutor (JPU).
“Because the Judges’ Verdict that was read out has taken over all legal considerations and legal facts presented in the Prosecutor’s Charge Letter,” he said in a written statement, Monday (13/2).
Previously, a panel of judges led by chairman Wahyu Iman Santoso found that Sambo was proven guilty of premeditated murder and without the right to commit an act that caused the electronic system to not function properly.
The former two-star police general is considered proven guilty of violating Article 340 of the Criminal Code in conjunction with Article 55 paragraph 1 1st of the Criminal Code and Article 49 in conjunction with Article 33 of the ITE Law in conjunction with Article 55 paragraph 1 of the 1st Criminal Code.
There are at least seven points of aggravating circumstances that the judge considered in making his decision against Sambo.
Among other things, Sambo’s actions caused unrest and uproar in the wider community; Sambo has tarnished the Polri institution in the eyes of the Indonesian public and the international world; until Sambo was judged to be complicated in giving testimony at trial and not admitting his actions.
Meanwhile, the judge thinks there is not a single mitigating circumstance for Sambo.
“There is no justifying and forgiving reason in the trial,” said the judge.
The murder of Yosua occurred on Friday, 8 July 2022 at the Sambo official residence number 46 at the Police Complex, Duren Tiga, South Jakarta. Richard Eliezer and Sambo are said to have shot Joshua.
This crime was committed by Sambo together with Putri Candrawathi, Richard Eliezer Pudihang Lumiu alias Bharada E, Ricky Rizal (Bripka RR) and Strong Ma’ruf.
Meanwhile, the obstruction of investigation case also involved a number of middle and high-ranking Polri officers who were in the Propam Division.
