The President of the Republic, Marcelo Rebelo de Sousa, enacted, this Tuesday, three diplomas of the Government, and among them, there is the diploma that establishes the person in charge of data processing and regulates the doctor’s intervention in the “STAYAWAY COVID” system.
“STAYAWAY COVID” is an application, available on iOS or Android operating systems, which uses ‘Bluetooth Low Energy’ technology as a proximity sensor and notifies users of individual exposure to SARS-CoV-2 contagion factors, due to contact with the user of the application who was subsequently diagnosed with COVID-19, working as a complementary and voluntary tool to respond to the epidemiological situation by reinforcing the identification of contacts.

The system was developed by the Institute of Computer Systems Engineering, Science and Technology (INESC TEC), in partnership with the Institute of Public Health of the University of Porto and the companies Keyruptive and Ubirider, within the scope of the National Digital Skills Initiative e. 2030.
The National Data Protection Commission, in its impact assessment on data protection, recommended that some aspects of its functioning be given a legal framework.
The approved diploma, on July 16, thus established the ‘STAYAWAY COVID’ obligation to respect the legislation and regulations on data protection and cybersecurity, and determines that the Directorate-General for Health is the managing authority of the system, being responsible for data processing for the purposes of European and national legislation applicable to the protection of personal data.
This Tuesday, Marcelo Rebelo de Sousa also promulgated the diploma that concretizes the transfer of competences to the municipal bodies and to the inter-municipal entities in the field of social action; and yet another that approves the refund of the amount equivalent to the value added tax (VAT) related to several initiatives.
