MTC proposes definitive cancellation and a fine of up to S / 17,200 for making false calls to emergency centers | Economy

The Ministry of Transport and Communications (MTC), proposed the definitive cancellation of internet telephony and data services, as well as the imposition of fines of up to S / 17,200 with the aim of discouraging malicious communications to the emergency and emergency centers. or information.

According to industry reports, from 2018 to date, 1,333 unscrupulous people made a total of 41,312 pernicious calls to emergency numbers, preventing timely attention from citizens in true danger.

In view of this situation, the MTC published the draft of the Supreme Decree that modifies the regulations of Legislative Decree No. 1277 that sanctions the carrying out of malicious communications to the emergency, urgency and information centers. The proposal establishes a new sanctioning regime that will allow an effective and unobstructed operation of the aforementioned plants, within the framework of the declaration of sanitary emergency.

In addition, the project maintains the preventive measure of partial suspension of outgoing voice and data traffic for those who repeatedly make false or prank calls to emergency centers. This is preceded by the Emergency Decree No. 026-2020, in force since March 16, 2020, which has allowed a significant decrease in the rate of malicious communications.

Proposal for fines, suspensions and cancellation of the service

The initiative proposes a different degree of sanctions depending on the type of call made (silent, disturbing or false), also taking into account whether there is a recurrence of the offending conduct.

For example, in the first instance, the MTC proposes to apply a fine ranging from S / 8,600 to S / 12,900, for users who incur in false calls. In case of recidivism, the telephone and Internet line could be permanently canceled or a fine of up to S / 17,200 could be applied, depending on the severity of the damage caused.

It should be noted that recidivism is considered, regardless of whether the offender makes malicious communications from one or more communication service numbers.

As an additional measure, the names of the people sanctioned for making malicious communications will remain in a registry that can be consulted by the general public.

Suspended lines

In this sense, it is worth noting that during the more than 100 days of quarantine decreed to prevent the spread of Covid-19, the MTC suspended a total of 2,043 fixed and mobile lines for incurring this damnable offense.

The emergency centers most affected by this type of irresponsible act were line 105 of the Peruvian National Police (PNP), 106 SAMU, 107 EsSalud, 113 Infosalud Minsa, 115 INDECI and 117 the Central Reguladora de Urgencias y EsSalud emergencies (CRUEN).
