The expulsion decision was handed down in a trial held in 2006. By majority vote, the STM understood that there was a ‘robust’ set of evidence that indicated that the behavior and attitudes of the then captain were not ‘consistent’ with his status as an officer . At the time, Ailton was a captain, but when he retired, he changed his rank to major, following military rules.

Ailton was accused of a series of ‘serious irregularities’, some of which the STM did not even analyze, due to the prescription of the episodes – they were prior to 1999. The expulsion took into account cases in which the then captain disrespected other officers and has been critical of the Army in interviews.

Among the prescribed ‘irregularities’ is the case in which the soldier, in 1997, would have tried to sexually abuse a ‘lady’ in an Army camp in Natal. To STM, the then captain denied the accusations. In the disciplinary sphere, he received punishment of eight days in prison.

Another episode that expired before Ailton was judged by the STM occurred in Rio, when the then military man ‘pushed’ a soldier with his car and ran over another officer, causing him ‘severe injuries to his left knee’.

Among the cases that were considered by the ministers of the military court to expel Ailton from the Army is the episode in which, in 2002, Ailton was involved in a traffic incident in Vila Militar in Rio and disrespected an Army Police soldier, trying to intimidate him. .

The STM also analyzed the situation in which Ailton ran for the state legislature, in 2002, as an active-duty soldier, and distributed pamphlets in which he appeared in an Army uniform and criticized the institution and his superiors.

In the evaluation of the Military Court, the then captain, ‘on several occasions sought to reduce the authority of soldiers who, performing roster duty, watched over security in military areas’.

“That’s what happened at Praia Vermelha, resulting in a Military Police Inquiry and a criminal action; that’s what happened in the residential area of ​​Vila Militar, when, distributing a pamphlet, he refused to identify himself; that’s what happened again in Vila Militar, when driving in speeding above the permitted, did not identify himself properly, threw his car against an Army soldier, resulting in IPM and criminal action in which he was convicted”, records Ailton’s conviction in the STM.

“On several occasions he failed to tell the truth, seeking to attribute the practice of racism to those who only fulfilled their duties as soldiers”, continued the document.

Now Ailton has entered the crosshairs of an investigation that is being processed by another superior court – the Federal Supreme Court. He was preventively by the Federal Police in Operation Venire, which also carried out searches against former president Jair Bolsonaro. The investigation targets a possible scheme of fraud in covid-19 vaccination data in the Ministry of Health systems.
