According to the administrative judge, it was not possible to demonstrate that women in service – such as nursing staff – were exposed to a particular risk. Contacts with others, the judge underlined, are part of the general risk of life. Therefore, women are not entitled to any additional monthly salary.

According to their statements, the plaintiffs are still suffering the consequences today. One of them is said to have been on sick leave since late 2020. Country NRW extension says corona infections are not accidents at work. The plaintiffs could have been infected anywhere.

The Augsburg court ruled in favor of a police officer in a similar case

This was the view of several administrative courts nationwide, including those in Bayreuth, Magdeburg and Sigmaringen. So far only the Administrative Court in Augsburg has recognized a corona infection as an occupational accident. A police officer there complained that he had contracted corona during a course.

In this case, the Administrative Court assumed that a private infection could be ruled out as the official had attended the training course continuously. He also stayed there with the riot police during the course.
