Justice Pushpa withdraws recommendation to uphold Ganediwala’s ruling that touching without changing clothes is not torture

New Delhi: The Supreme Court has withdrawn its recommendation to stabilize High Court Judge Justice Pushpa V Ganediwala. A three-member collegium headed by Chief Justice SA Bobdey recalled the recommendation sent to the Central Government on January 20 to stabilize Justice Pushpa v Ganediwala. The other members of the collegium are Justices NV Ramana and Rohinton Nariman.

Justice Pushpa is the judge who handed down the controversial verdict in the Pok‌mon cases. Justice Pushpa ruled that it was not sexual harassment to touch the body badly without touching the skin directly. Within a week, Pushpa V Ganediwala had acquitted the accused in three different cases in the Pokso case.

On January 19, a 12 – year – old boy was sentenced to life in prison for touching his chest without removing his clothes. The Supreme Court later upheld the verdict.
