Judgment – Ramfis Trujillo receives another setback in an attempt to aspire to the Presidency

The Superior Electoral Court (TSE) rejected the extremely urgent amparo action submitted by the applicant to the Presidency of the Republic by the National Citizens Will Party (PNVC), Ramfis Domínguez Trujillo, through which he intended to order the Central Board Electoral (JCE) the restoration of their citizenship rights to elect and be elected, and that of equality, after the electoral body rejected their candidacy.

The judges of the TSE determined that Domínguez Trujillo was not violated his fundamental rights of citizenship and equality that he invoked was incurred with the rejection of his candidacy proposal.

“Ultimately, the action denounced as injurious by the shareholder does not violate his fundamental rights, as the Central Electoral Board (JCE) is limited to compliance with the provisions of article 20 single paragraph of the Constitution of the Republic,” said the TSE.

The court indicated that, according to paragraph of article 20 of the Constitution, “Dominicans and Dominicans who adopt another nationality, by voluntary act or by place of birth, may aspire to the presidency and vice-presidency of the Republic, if they resign the nationality acquired ten years before the election and reside in the country during the ten years prior to the position ”.

The device of the decision TSE-352-2020, is that it was adopted by the unanimous vote of the judges headed by Román Jáquez Liranzo. The amparo action was submitted by the grandson of dictator Rafael Leonidas Trujillo Molina on February 28.

The JCE rejected Ramfis’ candidacy because he did not document his resignation to the nationality acquired by birth 10 years in advance, nor has he resided in the Dominican Republic during that period.
