Former President Faces Possible Trademark Infringement

A blog dedicated to fashion law has raised the possibility that Donald Trump may soon face a lawsuit in relation to his newly-launched signature sneaker line. The blog, called The Fashion Law, suggests that renowned shoe designer Christian Louboutin could argue that the former president copied the red-soled design, which has become a signature element of Louboutin’s footwear brand.

The Signature Sneaker Line

Trump introduced his custom Trump-branded sneakers, known as the “Never Surrender-High Tops,” at Sneaker Con, which took place at the Philadelphia Convention Center over the weekend. Priced at $399 per pair, only 1,000 pairs were made, and they quickly sold out.

The Alleged Trademark Infringement

According to The Fashion Law blog, Christian Louboutin’s red-soled design, which the brand has fought for trademark protection for several years, may have been imitated by Trump’s sneakers. Louboutin has previously challenged other shoemakers over the use of red soles in their designs.

Controversy and Possible Lawsuit

The potential lawsuit, though hypothetical at this point, centers around the red soles featured on Trump’s sneakers. The blog claims that this design element infringes on Louboutin’s trademarked red soles. However, there is currently no evidence of a pending lawsuit or cease-and-desist letter from Louboutin to Trump’s shoe brand.

Past Trademark Disputes

This would not be the first time Louboutin has faced a trademark dispute. In 2011, the brand sued Yves Saint Laurent for creating a monochrome red shoe that included a red sole. Although Louboutin’s trademark on the red sole was upheld, Yves Saint Laurent was allowed to produce and sell the red shoe, as the protection didn’t extend to when the entire shoe was red.

Potential Implications

If Trump’s sneakers do trigger a lawsuit, it could lead to changes in the shoe’s design. The Fashion Law blog suggests that Trump’s team has already acknowledged this possibility through a disclaimer on their website, stating that the product images provided are for illustration purposes only and may not accurately represent the product.
