The manufacturer Astrazeneca refuses compensation

Despite medical reports, the manufacturer rejects an out-of-court settlement. In a letter available to the MDR, the group emphasizes the “positive risk-benefit balance” of its Vaxzevria vaccine. The “very low” risk of suffering from sinus vein thrombosis with thrombocytopenia was already known at the time of vaccination and was part of the product information. Therefore, one is not obliged to pay compensation even if such a rare risk “unfortunately materializes” in individual cases.

Lawyer: The proceedings are unnecessarily prolonged

With the refusal of an out-of-court payment, Sebastian Schönert was forced to sue the manufacturer. Not having legal protection insurance, he had to pay upfront with his savings of around € 8,000. According to the young man, the risk in fighting a powerful pharmaceutical company with large financial resources would lie entirely with him. If he loses the trial, he has to pay all court and legal fees. The lawsuit was filed in March by Wiesbaden lawyer Joachim Caesar-Preller. However, the proceedings dragged on in vain and it would have taken months for the other party to respond to the complaint.
