With the help of the Berlin lawyer Ahmed Abed, the use of the room could be enforced against the declared BDS ban of the city of Frankfurt am Main. The decision of the 8th Senate of the Hessian Administrative Court (Az. 8 B 3012/20) states:
“The respondent is provisionally ordered by way of a temporary injunction to give the applicant (…) the” Great Hall “in the Saalbau Südbahnhof on December 5, 2020 under the usual contractual conditions from 2 pm to 6 pm”
The BT3P comment on this success against the city of Frankfurt am Main as follows:
Amir Ali: “Three years after the decision of the city of Frankfurt am Main against the BDS movement, the court has now clarified that it violates applicable fundamental rights. The city cannot forbid us to speak about human rights violations against the Palestinian people by the Israeli occupation and the demand for equal rights for all people in Israel and Palestine. All cities, municipalities and municipalities and the German Bundestag itself must quickly withdraw their discriminatory and illegal decisions against human rights work for the Palestinians. ”
Judith Bernstein: “For the second time, Mayor Uwe Becker tried to prevent the discussion about Palestinian human rights and failed again. Last year Becker tried in vain to prevent a lecture with me as the Jewish spokesperson for the Jewish-Palestinian Dialogue Group in Frankfurt. Becker compared me with the anti-Semitic murderer von Halle, which is why I filed a lawsuit against the city of Frankfurt am Main. ”
Christoph gloss: “The city of Frankfurt am Main allows demonstrations by the partly openly anti-Semitic lateral thinkers, but wants to prevent discussions by Palestinian, Jewish and German human rights activists on Palestine and Israel again and again. The only one who supports and helps them in this is the ultra-right and nationalist Israeli government and its occupation and apartheid policies towards the Palestinians. These human rights crimes committed daily by the State of Israel do not pause during the Covid-19 pandemic and therefore we will continue to work against them and not stop until freedom, equality and justice have been achieved for all Palestinians. ”
Ahmed Abed, Attorney at BT3P: “With the lifting of the room ban, the Hessian Administrative Court has declared the Frankfurt decision against BDS human rights activists to be legally irrelevant. The Bavarian Administrative Court, the Cologne Administrative Court and the Lower Saxony Higher Administrative Court could not find any anti-Semitism in the BDS movement in previous judgments and have also lifted all room bans. The German Bundestag should act now and withdraw the decision against the BDS movement and instead clearly condemn and sanction the illegal occupation of Israel. The European Court of Justice has called on the member states to enforce the labeling of Israeli settler goods in order to end the illegal Israeli occupation. “
The BT3P have filed a lawsuit against the Bundestag resolution banning the BDS movement. With the further judgment of the Hessian Administrative Court, they are even more convinced than before to win the trial against the German Bundestag.
