The public prosecutor of Castres has drawn up three protocols which were signed yesterday by the various partners in order to better fight against domestic violence and incivility.

In terms of the treatment of domestic violence, the Tarn has always had “a little head start” confides the prefect Catherine Ferrier delighted to have come to the judicial court of Castres to officially launch actions that will allow to go even further to fight against this scourge which exploded especially during confinements. “We went from two 2 cases per day to 3”, admits the prefect. This is why the Castres prosecutor Chérif Chabbi has drawn up several protocols resulting from “discussions with many partners for several weeks”. Starting with the one that provides for the deployment of anti-approach bracelets (BAR), an experiment launched everywhere in France since January 1. The BAR aims to control, by a mobile electronic surveillance device, the prohibition on a supervised person to get closer to another person in order to avoid the commission or the reiteration of domestic violence. At the same time, the protected person is assigned a mobile phone allowing them to geolocate them, contact them and also allow them to reach the teleoperator. The BAR device allows the protected person to benefit from a protection zone, made up of a pre-alert zone and an alert zone, within which the intrusion of the bearer of the BAR initiates an action of the teleoperator then, if necessary, the intervention of the police. The Castres court is given three bracelets, out of the 1,000 experienced in France, which can be put in place at all stages of the procedure. “The geographical constraints, the profile of the author, the fear of the victim are taken into account in deciding the use of the BAR”, confides Claire-Marie de Agostini, substitute in charge of family litigation, described as “fierce work “by the prosecutor” to get things done “. “The public prosecutor’s office in Castres is the one that seizes the family court the most in France to request protection orders,” says Chérif Chabbi. The BAR will therefore be an additional tool. “As soon as the complaint is filed, the victims are supported with the existing devices”, adds the deputy prosecutor who mentions the protection order or the 5 “great danger” telephones available to the jurisdiction which can be attributed to victims.

A second protocol was signed yesterday aimed at “strengthening the training of domestic violence referents in each department and discussing the difficulties encountered in the treatment of domestic violence, identifying good practices and disseminating the information necessary for multidisciplinary treatment that these files require “.

“The criminal decision is not everything”

Because for the prosecutor there needs to be a comprehensive approach to these cases with “synergy and all-round support”. “The effectiveness of public action depends on the articulation of all the partners, confirms the prefect satisfied to see” the whole chain come to life. “We see that the word is freed. That efforts have been made by the police so that the victims push the doors of the police stations and gendarmeries in confidence. Too often violence becomes like a mother tongue for them and they reproduce it “. The Tarn is rather at the forefront of the care of victims, particularly psychologically. But supporting authors is also an important axis to take into account. “The criminal decision is not everything”, indeed loose the prosecutor. “The author is sick, prisoner of his anger which he does not know how to express other than by blows”, affirms the prefect. “Addictions to alcohol or drugs are also omnipresent in these cases”, adds the president of the court Olivier Schweitzer. “10% of cases taken in charge by the Tarn penitentiary integration and probation service (Spip) concern convicted persons of domestic violence,” recalls Laurent Maynaud, the functional director of this service, who precisely mentions the establishment of speech and soon accommodation. The treatment of these authors is a priority for 2021. And the staff are ready to set up the BAR “. “The department has always been a pilot in this area, and I am proud to be from Tarn”, confides Bernad Vilamot, president of the judicial association of Tarn (AJT), an important link in this general mobilization.

A citizenship course is set up

Attacks on the Republic and its values ​​are a stated priority of the prosecutor Chérif Chabbi upon his arrival in Castres a few months ago. Like the third protocol that he designed and had yesterday signed by various partners in order to set up a citizenship course. An internship that can be offered, at its expense (180 €), as an alternative to prosecution or in addition to penalties, to perpetrators of incivility, of attacks on authority, such as rebellion or contempt, of acts of a racist or anti-Semitic nature, discrimination or damage to public property, or even light violence or attacks on private property. In short, all the attacks of everyday life which “destabilize the social order”. “The purpose of this internship is to remind the condemned of the republican values ​​of tolerance and respect for the dignity of the human person and to make him aware of his criminal and civil responsibility as well as of the duties involved in life in society. also aims to promote his social integration. Beyond the meaning of a sanction, it also has an educational vocation, “explains the prosecutor for whom” the attitudes of incivility or criminal behavior result, in fact, in some delinquents, a lack of integration of the values ​​that structure our society or the feeling of being excluded from it. ” The objective of the internship will therefore be to provide them with elements of knowledge allowing them to understand these rules as duties that life in society imposes and to register them within it, by telling them that they have all their square. Finally, the objective of this internship is to provide a penal, graduated, systematic response capable of preventing recidivism “.

The old “8” in reinforcement

The course will be carried out in two sequences on two different places. It will first include an intervention of the judicial association of Tarn-Prévention, orientation, support (AJT-POS) with a psychologist and a social worker, who “will boost the dynamics of the group, in order to initiate a process of accountability and intervention as a citizen, will place the exchanges in the historical framework and the law with a debriefing at the end of the internship. ” And the “trainees” will then be taken in hand by the president of the Amicale du 8e RPIMa de Castres, General Claude Régiment, and the historian of the Castres regiment Jacques Antoine, who will speak on the values ​​of the Republic, the meaning of individual and collective commitment, the link between the army and the nation. “The prosecutor’s proposal appealed to us because we are at the service of society, explains General Régigat. We have experience of violence, human relations, command, exchanges and conciliation. And we are ready to share. , bring our knowledge and bear witness to the values ​​of the Republic that we are already instilling in our young paras and that we carry viscerally. “
