Carnikava District Council contests inclusion in Ādaži District in Constitutional Court / Article / LSM.lv

Carnikava County Council has submitted an application to the Constitutional Court (SC), objecting to the inclusion of the municipality in Ādaži County after the administrative-territorial reform, informed Agnese Ģērmane, Head of the Public Relations Department of Carnikava County Council.

In the opinion of Carnikava municipality, the unification of Carnikava municipality has taken place in violation of the principle of local government included in the Satversme and the European Charter of Local Self-Government, the principle of proportionality established in the Satversme, as well as the principle of good legislation.

The norms of the law regarding Carnikava municipality have been adopted by purposefully merging Ādaži and Carnikava municipalities, without evaluation of such merger and proper consultations with Carnikava municipality.

Thus, the norms of the law concerning the municipality of Carnikava cannot be recognized as constitutional and creating legal consequences.

Carnikava County Council also invited the Minister of Environmental Protection and Regional Development Yuri Puce (HR) to participate in the public discussion on Administrative Territorial Reform in 2019, but the invitation was rejected and the Ministry did not provide any other ministry representative to listen to the population and respond. to their questions.

The opinion of the representatives of Carnikava municipality was not properly heard also in the meeting with the deputies of the municipalities organized by the Ministry of Environmental Protection and Regional Development in Ādaži last year.

In a survey conducted in the summer of 2019, the residents of the county expressed a negative position against the possible addition of Carnikava county to the administrative territories of other counties.

In Carnikava, the Latvian Farmers’ Union, which is in opposition in the Saeima, is in power.

As reported, several municipalities expressed readiness to turn to the ST against administrative-territorial reform.

According to the information provided by ST, by August 1, applications had been received from Limbaži municipality and Ikšķile municipality.

Later, the local government of Inčukalns municipality also informed that it had applied to the ST in connection with the Law on Administrative Territories and Settlements.

ST informed that a case has been initiated regarding the compliance of the inclusion of Ikšķile city and Tīnūži parish in Ogre region with the Satversme.
