Apple Challenges App Store Order in Epic Games Lawsuit Appeal to US Supreme Court

The big lawsuit between Apple and Epic isn’t completely over yet. Reuters reports that Apple is challenging part of the judgment in an appeal to the US Supreme Court. The aspect at stake is Apple’s obligation to let developers slip links to external stores into their apps. Ordered in the first instance, this point will allow developers to sell content without paying the App Store’s 30% commission.

If Apple mostly won its lawsuit against Epic, it still lost on some points. In particular, the judge asked that Apple authorize developers to leave links and buttons to external payment options in their applications. This is bad news for Apple, which therefore risks seeing part of its commission slip through the cracks of the App Store.

Both Cupertino and Epic appealed the judgment of the Court, which affirmed the first verdict and rejected the various requests for revisions. Apple therefore had to make compromises in the face of pressure from the competition authorities, and now authorizes certain external links redirecting to shops on the web. This change only affects a few types of apps, and games are not entitled to this honor: Fortnite would therefore not be affected if it were available on the App Store.

If this change seemed acquired, Apple does not deflate and wants to contest the judgment. Apple’s attorneys said Monday that the court was ” gone too far by issuing a nationwide injunction against Apple for allegedly violating a California unfair competition law.

This new challenge to the Supreme Court could reshuffle the cards. Apple said this request would raise questions ” important and far-reaching on the power of judges to issue sweeping injunctions. If Epic doesn’t speak at this time, the company could also go through a similar challenge.
