Alejandro Toledo: US judge rejects reconsideration of denial of bail | Odebrecht Justice Case

Appellate judge of the Northern District of California Vince Chhabria rejected a request for reconsideration of the decision that rejected the request for release on bail of former President Alejandro Toledo in the extradition process he faces in U.S for him Odebrecht case.

In his resolution, the magistrate remarks that the request of the former leader of Peru Possible was denied for two reasons. The first is that Toledo Manrique can’t claim it was “Unfairly surprised” or that he did not have the opportunity to present evidence on the issue of the risk of leakage.

The magistrate indicated that it has been made clear that Toledo represents a potential flight danger, in part because of the million dollars registered in accounts in accounts of his wife Eliane Karp.

In this sense, he alleged that the judge in charge of the extradition process, Thomas S. Hixson, found that Toledo “Misrepresented his wife’s financial resources” in an affidavit filed for the appointment of an attorney.

Judge Chhabria’s second reason for rejecting Toledo’s reconsideration is that, even if the ex-president was right that he does not pose a flight risk, “Did not demonstrate the existence of special circumstances” to be granted bail.

“Therefore, Toledo has not identified an adequate basis to reconsider the previous order of the Court.”, Chhabria concludes in its ruling.

Toledo Manrique He had submitted a second request for release on bail, which was rejected last week by Chhabria. The judge in charge of his case, Thomas S. Hixson, had denied him the first one last year.

The former president, in addition to requesting reconsideration, has appealed Chhabria’s decision before the Ninth Circuit of the United States Court of Appeals.

As recalled, the former Peruvian president is accused of having received up to US $ 30 million from the construction company Odebrecht in exchange for favoring the Brazilian company in the tender for sections II and III of the Interoceánica Sur highway.

Toledo Manrique has also spent the last two years on the run from Peruvian Justice in the United States, where he resides in the town of Menlo Park, near San Francisco.
