Threema can breathe again. The Federal Supreme Court gives the operator of the messenger of the same name right in proceedings against the Justice and Police Department (FDJP). Accordingly, Threema should be classified as a “provider of derived communications services” and not as a telecommunications service provider.
The FDJP saw this differently at the end of 2018 and declared Threema to be a telecommunications service provider – like Swisscom or Sunrise. “This classification would have made Threema subject to monitoring obligations, which cannot be reconciled with the consistent focus on the protection of privacy. Among other things, Threema would have been obliged to identify the users ‘with suitable means’ and to operate a data retention system”, explain the Operator of the Whatsapp alternative in a message.
Last June already the Federal Administrative Court decided in favor of Threema and declared the monitoring obligation null and void. In the announcement, the messenger operators are pleased with the confirmation by the Federal Supreme Court: “The fact that no precedent has been set at the expense of privacy is not only reassuring for Internet users, but also pleasing for local online services, which would otherwise involve considerable administrative overhead and large Competitive disadvantages compared to foreign competitors would have faced. “
