What conscripts and military personnel need to know to obtain a deferment on loans and microcredits

news-id-114572" style="display:inline;">Let us recall that in December 2022, a Memorandum of Mutual Cooperation was signed between the Ministry of Defense of the Republic of Kazakhstan and the Agency, providing for the provision of deferred payments on bank loans and microloans to borrowers called up for military service.

Fingramota.kz will talk about the algorithm of actions for providing deferred payments on bank loans and (or) microloans to conscripts and military personnel undergoing conscription military service:

1. The Ministry of Defense provides the Agency with a list of conscripts and military personnel undergoing compulsory military service who have loans, indicating personal data and the name of the bank or microfinance organization;

2. The Agency sends to banks, microfinance organizations or collection agencies lists of conscripts and military personnel undergoing compulsory military service and having bank loans and (or) microcredits received from the Ministry of Defense;

3. Banks and microfinance organizations promptly provide deferments, as well as suspend all forms of debt collection provided for by the legislation of the Republic of Kazakhstan.

The provision by banks and microfinance organizations of deferred payments on bank loans and microcredits is carried out in accordance with Articles 36 of the Law of the Republic of Kazakhstan “On Banks and Banking Activities in the Republic of Kazakhstan” and 9-2 of the Law of the Republic of Kazakhstan “On Microfinance Activities” upon application by a conscript or military personnel or his legal representative representative with an application and attached certificates confirming the fact of conscription or completion of compulsory military service by the serviceman.

Can the borrower personally contact the lender?
The borrower has the right to independently send an application to a bank or microfinance organization via e-mail, online “bank-client” system, Internet resource, mobile application, other means of communication, or by visiting the lender’s office. The application must be accompanied by a certificate confirming the fact of conscription or completion of compulsory military service.

Conscripts or military personnel are granted a deferment on loans upon personal application to the lender and according to the list of the Ministry of Defense. Representatives of the borrower can also submit an application to the lender using a power of attorney.

In this case, sending an additional application to the Agency is not required.

Actions of the creditor
During the period of deferment of payments on bank loans and (or) microloans on the principal debt and (or) remuneration, the lender suspends:

1) filing lawsuits, contacting a notary to issue a writ of execution to collect debt during the period of using the loan;

2) sale of housing, including that accepted on the balance sheet of a bank (an organization carrying out certain types of banking operations) for the obligations of the borrower (co-borrower, guarantor, mortgagor);

3) eviction of the borrower’s family (co-borrower, guarantor, mortgagor) from a home, including those on the balance sheet of a bank (an organization carrying out certain types of banking operations).

For loans and (or) microcredits for which judicial acts have been issued, the creditor suspends all forms of debt collection.

What to do if the creditor refuses?
If the creditor refuses to grant a deferment, the conscript or military serviceman has the right to officially contact the Agency in the following ways:

• Through the e-government portal of the Republic of Kazakhstan (in the “Electronic appeals” service, select “Order a service online” and fill out the text of the appeal with supporting documents attached;

• Using the eOtinish electronic service (The application is submitted through the eGov application, in the “Submit an Appeal” service you need to select “Application” and fill out the text of the application;

• In writing to the Agency’s address: A15S9T5, Almaty, Koktem-3 microdistrict, 21;

• To the Office of Regional Representatives of the Agency, whose addresses can be found on the Agency’s website.
