In Côte-d’Or, the submission of applications for the second round will take place on Friday May 29 (between 9 a.m. and 12:30 p.m. and between 2 p.m. and 5 p.m.) and Tuesday June 2 (between 9 a.m. and 12:30 p.m. and between 2 p.m. and 6 p.m.). In Sâone et Loire, the submission of applications will be made on the same dates by appointment.

For applicants who submitted an application on March 16, a final receipt will be notified to them by email. Their application being validated, these candidates do not have to come back to submit their application.

Rules for submitting applications in the second round

As part of the health measures in force, wearing a mask is compulsory and the number of candidates per municipality is limited to two for filing.

  • In municipalities with less than 1,000 inhabitants

The candidates in the first round, if they have not been elected, are automatically candidates for the second round, the legislator having not provided for the possibility of a withdrawal of candidacy between the two rounds (Article L. 255- 4 of the electoral code). In addition, new candidates may declare themselves in the second round in the event that there were fewer candidates in the first round than seats to be filled.

  • In municipalities with 1,000 or more inhabitants

– If the list continues:

A list can be maintained in the second round if it has obtained at least 10% of the votes cast in the first round organized on March 15, 2020. If it is maintained without merging, the candidates it presents are therefore strictly the same candidates as those presented in the first round, and in the same order.

– If the lists merge:

A list which obtained at least 5% of the votes cast on March 15, 2020 may present some of its candidates on a list which is maintained. Its candidates must all join the same welcoming list.

In the case of a list fusion, a “welcoming” list can include candidates from several “welcomed” lists. There is no upper limit on the number of lists and the number of candidates accepted, nor a limit on the number of candidates who join or remain on the welcoming list.

If a list is changed in its composition due to a merger, the order of presentation of candidates can then be changed. The person in charge of the welcoming list must notify the administration of the choice of the welcoming list. This notification can also be given when the applications are submitted by the welcoming list.

Removal from list

The lists of candidates who submitted an application on March 16 and 17 and wishing to withdraw their application can do so during the application period under common law conditions. Removing a list allows the list to merge and resubmit an application before June 2 (if it is a welcoming list).

As a reminder, withdrawal is necessarily decided by the majority of the members of the list, whose signatures appear on the document or documents presented to withdraw the application. The majority of candidates can withdraw their list, even without the agreement of the person responsible for the list.
