Was declared psychotic – three years later he is still serving a sentence

In 2011, a young man was sentenced to detention. He had tried to rape seven random young women, and that he committed a brutal assault rape.

The court-appointed experts thus concluded that the man, who is now 33 years old, was sane.

But he worked poorly in prison. In 2017, Ila Prison and Detention Center felt that it was necessary to find another solution.

As a result, he was released on probation to a home with a 24-hour guard.

While the 33-year-old lived here, he was guilty of new offenses, and he was charged again.

This time, new experts were brought in who concluded that the man was insane at the time of the atrocities.

– When I heard that he was perceived as psychotic, I thought it was very good. Because then you could get a sentence for compulsory mental health care, says one of the country’s leading psychiatrists, Randi Rosenqvist.

However, this was not the case.

Broke the terms

The 33-year-old is under the scheme state-funded probation – a scheme TV 2 has put the spotlight on the last time.

TV 2 has previously mentioned several matters surrounding the measure where he is staying. Among other things, he has received watch «rape related porn» and have sought out victims on social media.

The new offenses, which forced him to appear in court again, are primarily about him trying to rape a woman who was employed to look after him.

He had also assaulted a female patient in a hospital and made death threats against several people.

The Prison and Probation Service thought the offenses were clear violations of the security instructions, and questioned knows whether Stendi, who runs the measure, was suitable to have the care responsibility for the man.

Therefore, the prison service asked that the man be released from the parole system, and instead wanted him back in prison. Thus, they had to take the case to court.

Rosenqvist: – Shocked

It was in connection with this that it was decided that the convicted man had to be re-evaluated by experts. Their task was to take a stand on his mental health condition when he tried to rape the employee.

Rosenqvist had knowledge of the case from before, and when it became clear that he was psychotic, she took it for granted that the result would lead to him being transferred to the health service.

– We have had other cases where exactly that has happened, she says.

Instead, the court decided that he should remain on probation.

– I was quite shocked, and I think all the actors in this criminal case have neglected. They did not understand what the right reaction was, both legally and professionally, she says, and continues:

– A clear psychosis was diagnosed shortly before the criminal acts. Then there is obviously a reason for sentencing to compulsory mental health care, so that the person in question receives the treatment he needs as a psychotic person, and not a punishment such as detention after all.

– Long process

Rosenqvist believes it is not unique that erratic people are involved in various forms of execution of sentences.

She says she has been in several cases where the convicts have either been insane all the time – or that they have become so after conviction.

Recently, several similar cases have reached the public, including through the so-called Vollen case from 2014, where the Resumption Commission recently decided that the case should be taken up again.

TV 2 has also covered several cases where people with varying degrees of mental retardation held in sentencing for very many yearswhen according to current legislation they should have been on the special reaction forced care.

Rosenqvist calls for a more flexible system to be able to move people from the detention center to alternative special reactions.

– Converting detention to compulsory mental health care is a long process. I am very worried about those who are punished with a custodial sentence for offenses that were committed while they were insane, Rosenqvist says.

– Can not answer

TV 2 has tried to clarify whether transfer to the health service was a topic when the case was up in court.

The public prosecutor who brought this case to court is on leave from office today. Carl Philip Fleischer has taken over Jarland’s portfolio.

– Since I was not in court, I only know what emerges from the verdict. I can not answer the questions that are asked, says the public prosecutor.

Lawyer Elise Stilloff, who has represented the convicted person on the occasions that questions about continued parole have been dealt with in court, has not answered TV 2’s inquiries in this case.

Previously, she did not want to comment on cases about the 33-year-old.
