The acute political crisis in Ukraine has become even more acute. By trying to remove the head of the Constitutional Court, Tupitsky, from work, President Zelenskiy not only put himself in a stupid position, but also gave his opponents grounds to impeach himself. Who will win this battle, in which the American Embassy is one of the key participants?

For the new year 2014, which many people of Kiev decided to meet not in the family circle, but on the pre-revolutionary Maidan, another comedy with Vladimir Zelensky in the title role was released. It doesn’t matter what it was called, whether it was a sequel or a triquel. The main thing is that this is a kind of tradition of the then filmmaking: to release some rubbish for the New Year to make it funny and stupid, and in the main role – Zelensky.

However, the quality of films with Zelensky Is a separate conversation. Another thing is more important: if it had not been for the Euromaidan, which destroyed the political system of the country, and then the country itself, this tradition would probably have continued to be observed – for some reason, such pictures of Russian-Ukrainian production were loved by a mass audience (or, at least, they watched and paid for tickets).

The Ukrainians who are nostalgic for those times (and there are probably many of them; it is no wonder to feel nostalgic for the times without war and ideological terror, when there was much less need and devastation), have a great opportunity to plunge into them again. On the screens, another comedy starring Zelensky, in which the President of Ukraine is at war with the Constitutional Court.

The war is not like that of Count Tolstoy or in the Donbass, but in the style of The Benny Hill Show.

On Tuesday, Zelensky suspended the head of the Constitutional Court of Ukraine (CCU) Oleksandr Tupitsky from his duties for two months. And spoilers immediately: the president did not have the authority to do this, so the judge did not obey the decision of the head of state. The Office of the President decided to insist on their own and demanded that the state guard cancel Tupitsky’s pass to the building of the KSU, but in the end the chief judge calmly went to his workplace on a temporary pass issued to him by the secretary.

The level of the mess clearly shows that this is already a Ukrainian national comedy, and not, as before, a film co-produced with Russia.

Now the alignment is such that the CCU does not recognize the president’s decision, accuses of violating the constitution and threatens criminal liability… How Zelensky will answer this is a question, but he will definitely answer with something: the stakes in this farce are extremely high.

The fact is that earlier the CCU annulled part of the country’s anti-corruption legislation, adopted after the Euromaidan and not corresponding, according to the court, to the constitution. However, this legislation is part of a deal between Kiev and the West, the other parts of which are assistance from international financial institutions and a visa-free regime with the EU, issued to Ukrainians in advance.

Simply put, if the CCU does not cancel its decision, visa-free travel can be canceled, and no more money will be given. But Kiev needs money – and urgently.

In fact, the anti-corruption legislation of Ukraine, like the special anti-corruption body – NABU, is instrument of external control over the state… Here you can be indignant at the trade in sovereignty for a long time, but the West can also be understood: what is the point of allocating funds to Ukraine “for development” if they are banal plundered?

In the eyes of Zelensky, everything that happens is intrigue pro-Russian oppositionwho is trying to frame him. You can’t deny him the right to think so. The request to the KSU, which started it all, was sent by the Opposition Platform – For Life party, explaining this by the desire to wrest the control lever of the country from the hands of foreigners, and Viktor Yanukovych appointed judge Tupitsky on the presidential quota.

True, Tupitsky alone could not make such a decision – he was assisted by judges appointed by the other president, Petro Poroshenko. A significant part of the scandalous laws and amendments to the anti-corruption package was adopted under him, but now the nationalists are acting according to the scheme “the worse for Zelensky, the better.”

The head of the Ukrainian state is trying to somehow manage the crisis that has arisen – this is demanded of him from Washington, Brussels and the IMF. But this cannot be done in harmony with the laws in force, and the pro-presidential faction “Servant of the People” in the Verkhovna Rada did not want to dissolve the KSU in violation of the constitution.

While many of these people, literally recruited by ad, owe their political careers and seats in parliament to Zelenskiy’s brand, they nevertheless do not want to share the burden of possible responsibility with their patron. In addition, a number of deputies are controlled by the scandalous oligarch Igor Kolomoisky, the alleged author of the Zelensky project. Now they have a difficult relationship with the president – the IMF is categorically opposed to the cancellation of the decision to nationalize Privatbank, that is, the president is caught between two fires, but the IMF is a much more important sponsor for him.

Then Zelensky decided to show his teeth and do everything himself, but the result was a farce, traditional for his previous profession. The request to dismiss the head of the KSU was drawn up by the Prosecutor General’s Office, but the suspicions were voiced unconvincing – the judge is credited with perjury.

Another suspicious dacha – in Crimea two months earlier, another “power nest” was found – by the State Bureau of Investigation, initiating a case against Tupitsky with a loud accusation in high treason… According to the investigation, in 2018 Tupitsky acquired a land plot in the “occupied territory”. According to Tupitsky himself, he had a land plot in Crimea before, and the purchase was only a re-registration. At the same time, the judge cannot use this property – he is included in the sanctions lists from the Russian side. So-so goes “treason”.

Despite the obviously ordered nature of these cases, the population of Ukraine is mostly on the side of Zelensky and anti-corruption laws, that is, against the KSU. Western curators, in theory, too, and the US Embassy remains one of the most important centers of power in the country, which is recognized by all local political scientists. However, Zelensky will have to somehow explain his methodology for resolving the crisis, and it is not a fact that he will be correctly understood: in the American tradition, the constitutional court (in the USA it is called the Supreme) is omnipotent organization, in whose activities no one has the right to interfere, otherwise it will be under threat American statehood itself.

What will happen to the Ukrainian statehood, and who will get out of this fight with the least losses – we will see. What is happening can become both the personal victoria of Zelensky, who has finally shown strength and made him reckon with, and the beginning of its end.

“The Ukrainian constitution contains a clearly defined list of the president’s powers. In accordance with it, Zelensky did not have the right to remove a judge of the Constitutional Court even for two months. Such a violation may well become another reason for starting the procedure for impeachment of the president, ” commented on the situation Kiev political scientist Mikhail Pogrebinsky for the VZGLYAD newspaper.

“Today there are no forces in parliament to initiate and conduct impeachment proceedings, because this requires three quarters of the votes of the deputies. But over time it will happen, ”added Ruslan Bortnik, director of the Ukrainian Institute of Politics.

The risk of a riot on the presidential ship (more precisely, in the pro-presidential faction) will increase the more the more confident Zelensky’s rating is will continue to go to zero… The electoral strength of a recently very popular leader is running out, which poses a question for his team – is it worth getting involved in a violation of the basic law if the main beneficiary soon goes bankrupt as a politician?

If they decide not, it’s not worth it – finita la commedia. Light star Zelenskiy has yet to learn that movies don’t have to end well.
