The final dispatch of the indictment signed by a group of public prosecutors led by José Ranito, there is a point on “testimonial evidence and by making statements”, where they list the people who were heard by the Central Department of Investigation and Criminal Action ( DCIAP) over the six years of investigation, of the Universe Espírito Santo process.

According to the Criminal Procedure Code, and “because the procedure proves to be exceptionally complex”, and also given the time period in question, “the number of (offended) people involved, the pecuniary values ​​found, the number of imputed crimes , the extension of the documentary evidence, the Public Ministry indicates a
number of witnesses whose hearing is required, exceeding 20 ”. In the specific case, we counted 122.

Who is among the witnesses to an investigation process launched in 2014 and which ended yesterday? We met Fernando Ulrich, BPI’s non-executive chairman and at the time of BES’s resolution in 2014, the bank’s CEO. But also José Maria Ricciardi, who was president of BES Investimento – the bank contracted for the construction of ESI and Rioforte’s domestic paper programs, in September 2013, unaware of the reality of liability concealment, which the prosecuting order calls “ non-conformities in ESI accounts ”.

According to the reports in the file, José Maria Ricciardi told Ricardo Salgado that he would report the situation to the supervision and that he was unaware of the state of ESI’s accounts. This is the accumulation of 1.3 billion euros of debt in ESI was the result of losses, at least, since 2009, and that was not visible in the company’s balance sheet.

From the Espírito Santo family, Peter Brito and Cunha, former president of Tranquilidade, were pressured to invest 150 million euros in Rioforte’s commercial paper, in the last days of Ricardo Salgado at the head of BES and Carloto Beirão da Veiga, the administrator of the Herdade da Comporta Fund.

The list of witnesses also includes Francisco Cary, current administrator of Caixa Geral de Depósitos, and at the time administrator of BESI, and António Ramalho, current president of Novo Banco.

But also Pedro Queiroz Pereira, who died in August 2018. It should be remembered that in 2013, a conflict between Semapa’s entrepreneur and Ricardo Salgado set off in a judicial dispute in which he was placed in
highlight a possible misrepresentation of the GES holding accounts, a fact that will have been revealed to banking supervision in the second half of 2013.

Queiroz Pereira accused Ricardo Salgado of intending to capture liquidity outside GES, through the Semapa Group, and as such to continue an attempt to take partial control of this Group.

Also on the list is Rita Amaral Cabral, close to Marcelo Rebelo de Sousa and the non-executive director of BES, and Sikander Sattar, who led the KPMG auditor. In addition to Helder Batáglia, former leader of Escom, who confessed to prosecutors that it was not said that no to Ricardo Salgado. For the Public Ministry, Helder Batáglia’s testimony in another case, Operation Marquis, became essential.

Also the builder José Guilherme, who gave 14 million euros to Ricardo Salgado, and which the former president of BES justified as being a liberality, that is, a personal gift from the builder who was a customer of the bank and had credit granted by the institution.

Amadora’s biggest civil builder decided to invest in Angola because he would have convinced Ricardo Salgado years ago. For this reason, and for the support that the banker gave him to enter Angola as one of the biggest real estate investors in Luanda, the businessman decided to thank him with a transfer of 14 million euros to a personal account of Ricardo Salgado in Switzerland.

Ricardo Salgado is one of 25 defendants, 18 people and seven companies, accused by the Central Department of Investigation and Criminal Action (DCIAP), who for almost six years tried to unravel a complex web of companies and financial schemes that led to the collapse of the Espírito Santo universe , in 2014.
