The head of the cabinet of the caretaker Interior Minister Boyko Rashkov Elena Ficherova-Karaivanova was disciplinary fired by KPCOMPI by the chairman of the commission Sotir Tsatsarov in March last year after an established conflict of interests. On March 20, 2017, Ms. Elena Ficherova-Karaivanova was appointed to the position of “Chief Legal Adviser” in the “Legal” Department of the “Administrative Legal and Information Services” Directorate in the Commission for Confiscation of Illegally Acquired Property, and two months later appointed by the Chairman of CONPI (Plamen Georgiev) to perform internally the position of Head of the Human Resources Department, until the appointment of a holder. On 23.08.2017 she was appointed head of this department, after a competitive procedure. Following the merger of CONPI into the newly established Commission for Combating Corruption and Confiscation of Illegally Acquired Property, Elena Ficherova-Karaivanova was reassigned to the same position in KPCONPI.

By order of the Chairman of the Commission dated 08.05.2018, it has been ordered to carry out selection among employees with managerial positions to hold the position of “Director of the Coordination, Coordination and Interaction Directorate / SWR /. The order was also coordinated by Ms. Ficherova-Karaivanova personally, in her capacity as Head of the Human Resources Department. Within the same working day /08.05.2018 /, the following actions were performed:

– Ms. Ficherova-Karaivanova presented a reference with the names of three employees who meet the conditions for holding the position. One of these three employees is herself;

– the experts in the Human Resources Department headed by her have prepared a letter-proposal on behalf of the Chairman of KPCONPI to the three candidates;

– Ms. Ficherova-Karaivanova agreed to be reappointed as director of the directorate and she was offered the position;

– an order was issued by the chairman Plamen Georgiev for appointment and the job description was handed over;

– the amount of her monthly remuneration has also been increased.

The very next day – May 9, 2018, Ms. Ficherova-Karaivanova has applied to be reinstated as Head of Human Resources. Her request was granted, and her salary remained the same as for the higher position of “Director of SWR”. In practice, the one-day “stay” of Elena Ficherova-Karaivanova in the position of director was carried out only in order to create grounds for increasing her salary. In August 2019 and February 2020, Ficherova’s individual monthly salary was increased.

On February 28, 2020, after an inspection – analysis of human resources management in the Commission, the head of the General Inspectorate at the Council of Ministers informed the chairman of KPCONPI by letter that there is evidence of a possible conflict of interest of Elena Ficherova – Karaivanova. On 04.03.2020 proceedings were instituted to establish a conflict of interest against Ms. Ficherova – Karaivanova. On March 10, 2020, all materials on the proceedings for establishing a conflict of interest were provided to her for acquaintance. In the period from November 2020 to January 2021, she repeatedly declined the written and oral invitations to appear for a hearing before the Standing Committee, appointed by order of the Chairman of KPCONPI. In January 2021, the invitation was delivered to her in person. On January 29, 2021, she was heard in the presence of her lawyer. They were informed that the proceedings were being conducted for the fact that she personally, as head of the Human Resources Department, had participated in the procedure for her own appointment as director. By Order № RD 10-04 / 26.03.2021 of the Chairperson of KPKONPI a conflict of interests was established with regard to Ms. Ficherova – Karaivanova for the fact that she participated in the procedure for her own appointment as Director of the SWR Directorate. Financial sanctions have also been imposed on her.

Elena Ficherova-Karaivanova was disciplinary dismissed by order of the Chairperson of KPKONPI Sotir Tsatsarov on March 26, 2020 from her position of Head of Human Resources Department in the Directorate of Administrative, Legal and Information Services (APIO) of KPKONPI. The grounds for imposing the penalty are violations for improper payment of remuneration for the project “Increasing the expert capacity of KPCONPI for effective and professional preparation of assessment and analysis of sets of monetary rights and obligations”, funded by the Operational Program “Good Governance “, At which Ms. Ficherova-Karaivanova was appointed head on August 26, 2018. The established violation concerns the approval of documents by Ms. Ficherova-Karaivanova, leading to the payment of additional remuneration to the project team (including the project itself). it), without the same being approved by the Chairman of KPCONPI, as required by the Internal Rules for the implementation of projects under the European Structural and Investment Funds. The documents thus directly approved by it were submitted for payment to the Commission’s Finance Directorate. In her explanations to the disciplinary commission, Ms. Ficherova-Karaivanova stated that “I do not remember any provision obliging me to submit the minutes to the appointing authority.”

At present, the order for disciplinary dismissal, as well as the one for establishing a conflict of interest, are subject to judicial challenge by Elena Ficherova – Karaivanova, and for both there is no final judicial act.
