This is how the transfer agreement between the NHL and the National League works

The transfer agreement with the NHL is finally in dry cloth and is effective immediately. The excitement about the substitute foreigners is a storm in a glass of water.

The transfer agreement between the National League and the NHL became official on Tuesday. This regulates transfers from Swiss clubs to the NHL.

The NHL may oblige any player from the National League until July 15th. Regardless of whether he has an ongoing contract. In return, the NHL now pays a transfer fee of slightly more than CHF 200,000 for each player without a contract from the National League, provided that he has played at least 50 games in the National League and in the previous season at a Swiss club was under contract.

This rule also applies to all foreign players with a Swiss license, such as Ambris Dominic Zwerger or Langnaus Ivars Punnenovs.

In recent weeks, the accompanying measures that the club bosses have decided, but which have obviously not been explained to their sporting bosses, have caused a stir. The clubs can replace a player they lose due to the NHL transfer agreement from a current contract for the season and the following season with an additional foreigner – provided that player has already played 50 games in the National League. If the player returns from the NHL during the season, the additional foreigner license expires. However, there should be an application to the League Assembly to restrict the replacement foreigner to the season in question.

Substitute foreigners despite the exit clause

The excitement was about the exit clauses in the contracts. Can a player be replaced by a foreigner who has an exit clause for the NHL in his contract? The answer is now clear: yes. Because the exit clauses are no longer applicable due to the NHL transfer agreement. In the event of an incident, the ZSC Lions may replace Pius Suter (under contract until 2023) with a foreigner and play with five foreigners next and the following season.

In contrast, the SCB Gaëtan Haas cannot replace with a fifth foreigner. The striker has just extended the contract with the Edmonton Oilers to 2021, but also has a contract with the SCB until 2021. But he didn’t play in the National League last season, but in the NHL. SCB manager Marc Lüthi confirms: «Yes, it is so. We cannot commit additional foreigners to Haas. »

The accompanying measures are clear and do not allow for cunning eggs. So the excitement was just a storm in a glass of water. In any case, it affects very few players, currently only Zurich’s Pius Suter.

The NHL transfer agreement is effective immediately. It remains to be seen whether and how conditions will change due to the virus crisis. If the NHL ended the season and the new season didn’t start until November or December, the deadlines for signing National League players would likely be renegotiated.
