The Mixed Regional Chamber of the Court of Appeals of the department of Petén granted provisional protection and annulled the shortlist of candidates for governor of that department.

According to the document, the voting for the election of the shortlist of candidates violated the principle of publicity, in accordance with article 30 of the Political Constitution of the Republic.

“In this matter, the circumstances arise as stipulated in article 28, paragraph (d) of the Exhibition, Personal and Constitutional Protection Law, by virtue of which the provisional protection requested by the amparo is granted; VI) Consequence of the Provisional Amparo granted,” the document describes.

In light of the above, minute 05-2024 containing the extraordinary meeting of the Departmental Development Council of Petén is provisionally suspended, in which the shortlist of candidates for regular and alternate governor of the department of Petén was selected.

Likewise, the letter details that this situation will remain until the present constitutional action for protection is definitively resolved or the provisional protection granted is revoked by this court or by a competent jurisdictional body.

It also gives a period of 48 hours and two days to the Departmental Development Council of Petén to submit the detailed report on the public session, the procedure for selecting the shortlist and the way in which the vote was taken to integrate the shortlists of candidates for occupy the position of governor of the department.
