The main police officer implicated in Theo case could escape the rape charge but not the Assize Court.
The Bobigny public prosecutor’s office announced on Wednesday that it had required the reclassification of the facts of “aggravated rape” as “willful violence with a weapon by a person holding public authority having resulted in mutilation or permanent partial incapacity”, against d ” one of the police officers indicted for having injured Théo, on February 2, 2017 in Aulnay-sous-Bois (Seine-Saint-Denis).
Two other police officers sent back to the Assize Court
The young man, 22 years old at the time, had been seriously injured in the anus by a baton from a police officer.
The prosecution also requested the dismissal of two other police officers before an Assize Court, for acts of willful violence committed “after his arrest” and a dismissal for a fourth official.
It is now up to the examining magistrate to issue a referral order, the last act before a trial is held.
