The Olomouc Regional Court Awards Compensation to Roma Children for Assault in Castle Park

The Olomouc Regional Court awarded compensation in the amount of 170,000 crowns for non-pecuniary damage to six Roma children who, according to the judgment, were attacked by the Pumprl couple in 2019 in the castle park in Lipník nad Bečvou in Přerovsk. The courts initially did not award compensation to the victims and referred them to civil proceedings. The opinion had to be reconsidered by the regional court after their representative succeeded in filing a complaint with the Constitutional Court (ÚS).

The Romea.cz server drew attention to the case, the information was confirmed by the representative of the victims, Klára Kalibová.

The Supreme Administrative Court overturned part of the verdict of the Olomouc Regional Court, which rejected the proposal to pay non-pecuniary damage, and awarded only painful damages to four of the defendants. He referred them to civil proceedings with other claims. According to the ÚS, the basic rights of the victims were significantly violated.

“After the decision of the Constitutional Court, the court had no other chance but to decide as it decided. He granted full compensation for non-pecuniary damage to some children, and reduced it to some, but not significantly. The lowest compensation was 10,000 crowns, the highest was 50,000 crowns, in total it was 170,000 crowns, we originally demanded 230,000 crowns,” Kalibová said.

Both spouses have already been punished by the courts for the assault, and their decision in this case is final – the court sentenced Stanislav Pumprl to 14 months suspended for three years, his wife Petra received a twelve-month sentence with a two-year probationary period. The Přerov and then the regional court awarded four of the attacked victims monetary damages in the amount of 35,000 crowns.

“To this day, the perpetrators have not paid anything for the damage to health, enforcement proceedings have already been initiated against them in the matter of property damage. We have no signs from them that they want to pay anything voluntarily. Thus, the burden on the injured parties will continue, that they will have to continue to recover it,” the representative added.

The case happened in April 2019. According to the verdict, the couple first racially insulted a group of seven children, then punched them in the face and slapped them. In several cases, the attackers allegedly knocked the children to the ground with their fists and kicked them. According to medical reports, the children suffered cervical spine sprains as well as superficial injuries, a slight concussion and bruises. The defendants denied their guilt the entire time, stating that they were dealing with minors in the park, on the contrary, that they had verbally attacked their daughter.

The police initially investigated the case as an offense against civil coexistence, later reclassifying it as the crime of attempted bodily harm and disorderly conduct. Finally, the police started prosecuting the couple also due to racial motives. The incident caused tension in the city, the police cooperated with the town hall, a specialist in Roma issues and also with crime prevention assistants to calm the situation.
