After a long legal procedure, an emergency doctor from Dijon (Côte-d’Or) won his case against the University Hospital Center. For having violated professional secrecy, the health establishment was sentenced on Monday March 7 to pay €50,000 to the former Samu doctor, reports The Public Good.
In 2011, the caregiver is suspected of diverting opiates when in reality he was suffering from severe migraines. A procedure was launched against him and a report was made to the public prosecutor, explain our colleagues.
A confidential document
As part of this procedure, the CHU sent to the courts a ” roadmap “, a strictly confidential document. The file also contains numerous administrative documents. Upon discovering this, the doctor decided to file a complaint for violation and concealment of medical secrecy against the CHU, indicates the regional daily. He then quit his job.
The case was quickly dismissed in 2012. However, the emergency doctor filed a new complaint in 2014 with a civil action, which relaunched the judicial machine. During the hearing, the management of the CHU explained that it did not know under what circumstances the official document had been added to the file.
