The court is awaiting a doctor for an opinion on the simulant

The applicant accuses the retired woman of directing the Commission to its incorrect conclusion, by its unprofessional and grossly negligent conduct, that the man is suffering from a third-degree invalidity, when, in fact, his state of health did not correspond. The state was thus to unjustifiably pay him almost three quarters of a million crowns.

Zdeněk B. faces up to a year in prison for the offense of obstructing the task of an official due to negligence. “I find gross negligence in the conduct of the defendant. Although the nature of the breach of duty borders on intentional conduct, there is no evidence for that, “says the indictment with which Právo became acquainted.

It is also clear from her text that Zdeněk B. refused to testify. Her employment with the Ministry of Labor ended in June 2019. The whole story began in 2015.

It was in 2015 that the social security administration granted former air pilot Jindřich S. full disability. After two years, however, she revoked her decision when the police found out that a former Czech Airlines employee had submitted altered or even falsified medical reports to assess his health, which were supposed to turn him into a helpless person dependent on the help of others.

However, in 2018 the administrative court annulled the decision of the district social security administration and granted Jindřich S. his disability back when he relied on the conclusions of the mentioned assessment commission (MLSA), at which he had an opinion prepared. However, the investigators found that Zdeněk B. proceeded abnormally in preparing the documents for the commission’s decision by failing to take into account the objective and genuine medical findings already known at the time, which police officers had obtained from the relevant experts and which were already part of the background material for the commission.

As the head of the commission, Zdeněk B. had the task of preparing a search, which contains substantial excerpts from medical reports and serves as a basic framework for preparing the report itself.

“The accused did not pay sufficient attention to the study of medical documentation during the processing of this search as a key basis for other members of the assessment committee. In fact, she resigned from her duties of properly ascertaining the health status of the person being assessed, failing to take into account the verified medical reports provided by the police, which were already available to her at the time, “the public prosecutor argues.

She also pointed out that if Zdeněk B. had relied on documents provided by the police and carefully examined the file documentation of the social security body, the commission would not be able to grant the person concerned any degree of disability, nor would he be granted a care allowance and a medical card. disability. “The accused did not draw the attention of the members of the commission to the amended medical reports submitted by the assessee,” the applicant emphasized.

He should have been completely healthy

The case of Jindřich S. has already been heard by the court earlier. “As an actor, supported by false medical reports, he received a full disability pension, illegally received a sickness benefit, and still collected money from insurance policies,” the prosecutor said. In total, insurance companies and the social security administration had to unjustifiably pay him two and a half million crowns. He faces up to 10 years in prison for fraud and forgery of medical reports.

According to the criminal record, in 2014, after being fired at work for smuggling untaxed cigarettes from the duty-free zone, he pretended to collapse and subsequent health problems resulting from an alleged head injury, such as visual, hearing or balance disorders.

The man, who then presented himself as a heavy disabled person who could not get out of bed without help and stay on his feet only with the help of French sticks, was later filmed by police officers in situations where he behaved like a completely healthy person.

He drove a car, went shopping or mowed the lawn. During the house search, criminal investigators discovered photos and videos from family trips, where Jindřich S. is even captured on a cable car or a motorboat, without any signs of any medical condition.

His wedding was in the same spirit. The footage shows how he sweeps the shards from a broken plate with a broom or how he dances with his wife. Detectives have even found out that he rides clubs like a disc jockey.
