Superbus wins lawsuit against Universal: Jennifer Ayache’s group gets € 1.2 million

In the long legal battle between the rock group Superbus Universal Music, her former record company, justice finally decided to decide in favor of the singer’s group Jennifer Ayache, as Capital reveals. According to the verdict of the court of cassation, a record company does not have the right to thank a rock group following bad sales, or a disagreement between its members. Superbus will therefore receive € 1.2 million as compensatory indemnities.

For the record, the problems between the rock group and the record company began after the drummer of Superbus, Greg Jacks, created in 2010 another group in parallel, baptized The Dukes. Left to settle in Arizona, he was then dismissed by Universal at the request of the other members of the group. The latter mentioned his absence during several concerts in 2012, as well as a deterioration of the atmosphere within Superbus to justify his dismissal. Thereafter Universal thanked the other members of the group on May 11, 2015, after 14 years of collaboration.

Superbus vs Universal: four years of proceedings

Furious, the members of Superbus then decided to attack the group’s subsidiary Vivendi in justice. During their legal battle, Universal particularly criticized the group, which quickly signed with Warner following his dismissal, to have started negotiations with his competitor before his dismissal. On their side, Jennifer Ayache and his acolytes criticized the major for not having carried out any promotion of their last album, Sunset. Officially, Universal would have thanked the group for economic reasons, because its albums sold less and less.

However, the record company did not have the right to terminate its contract with Superbus only for this reason. In the end, the judges considered thatUniversal had terminated the contracts of the artists of the group unilaterally, without valid reason, and that the major had, therefore, to pay the rockers the sums they should have received if the contracts in question had ended. Thus, each member of Superbus obtained between 242,000 and 292,000 euros in compensation.
