Uber drivers and livreurs Deliveroo will they soon be able to vote in union elections? According to information from Franceinfo, the Ministry of Labor would be in favor. This proposal was made by the former HRD of Orange, Bruno Mettling, who is working on the issue at the request of the government. The first election could take place in 2022.

Two ballots would be organized: one for VTC drivers and the other for delivery people. Only workers with a minimum of seniority (6 months for example) could vote. The full project is due on March 12. It could be transcribed into a prescription as early as the spring.

“Gray area of ​​employment”

The issue of social dialogue within the platforms is crucial. The issue of negotiating tariffs crystallizes a number of tensions. But many other subjects are on the table, in particular the status and social protection of these workers, currently in a “gray area of ​​employment”, according to the formulation of the Frouin Report.

Former president of the social chamber of the Court of Cassation, Jean-Yves Frouin indeed submitted a report to the government in December on the regulation of digital work platforms. He also mentions the issue of social dialogue.

Provide security

But, above all, he suggests requiring regular platform workers to go through a third party to pay them (wage portage company or cooperative, for example). The additional cost could be partly covered by the platforms. This model would have the virtue of providing them with security, in the absence of being able to recognize the status of employee for all.

This last option would bring clarification , but as the Frouin report underlines, it was not not the working hypothesis of the public authorities .
