Roman Giertych in the hospital. Attorney Wende: there is deterioration in health, there will be toxicological tests

We still do not know what’s wrong with him, and the results are bad – said Jakub Wende, lawyer for Roman Giertych, who was in the hospital since he fainted during the search of his house by agents of the Central Anticorruption Bureau. He added that Giertych’s toxicological studies “will most likely be commissioned abroad”.

Attorney Roman Giertych and businessman Ryszard Krauze are among the 12 people arrested on Thursday in connection with the investigation into the removal and appropriation of a total of PLN 92 million from the listed developer Polnord. On Thursday afternoon Giertych was taken to a hospital in Warsaw after he fainted while his home was searched by CBA officers. He is currently in the Bródno hospital.

Jakub Wende, lawyer, spoke about Roman Giertych’s health on Monday. – Today I received information that the hospital where Roman Giertych is staying will order toxicological tests for my client – he informed.

As he explained, “this decision is associated with a significant deterioration in his health from the moment of his arrest and diagnostic problems”. “We still don’t know what’s wrong with him and the results are bad,” added Wende.

– As I have determined, toxicological tests will most likely be commissioned abroad, because not all the necessary reagents are available in Poland – informed the patron. Wende added that his client felt better than in the previous days.

Conflicting information on the patron’s health

After Giertych was admitted to the hospital, contradictory information appeared regarding his health.

On Thursday evening, the spokesman of the minister of the special services coordinator, Stanisław Żaryn, assured that Giertych’s condition was good. On Friday morning, the lawyer’s wife Barbara Giertych said on Twitter that “contrary to what Stanisław Żaryn claims”, her husband’s health condition is “serious”.

The discrepancies also concern the state of health in which Giertych was during the day on Friday. One of the people who stayed in the hospital at Giertych on that day was Hanna Machińska, deputy Commissioner for Human Rights. – He said that an unheard-of situation happened to him, that he had never fainted in his life, that he was in the bathroom of the apartment with the agent and then, quote: “he did something, I passed out and I don’t know what happened next, I woke up only in the hospital “- she said, reporting her conversation with the patron.

Giertych’s attorney, attorney Jakub Wende, in an interview with journalists in front of the hospital on Friday said that, both according to observations and information from doctors, the health of his client “certainly cannot be called good”. He added that “actually all day” Giertych was unconscious.

Preventive measures were taken against Giertych

On Thursday, the detainees were charged with the misappropriation of the company’s funds and inflicting large-scale property damage on the company as well as money laundering. For this, he is threatened with up to 10 years in prison. The proceedings conducted by the Poznań regional prosecutor’s office concern two issues: purchase of worthless – according to the prosecutor’s office – receivables of Prokom Investments SA in the amount of nearly PLN 73 million and purchase of real estate at an inflated price for less than PLN 27 million.

The regional prosecutor in Poznań, Jacek Motawski, said on Saturday that “after the effective” – ​​as he assessed – the charges against Roman Giertych, preventive measures were taken in the form of a five million zloty bail, suspension of the lawyer’s activities, prohibition to leave the country, police supervision combined with a ban on contact with the other suspects.

In the opinion of Giertych’s attorneys, however, the charges were not effectively brought against him, because when they were read out, the attorney was unconscious.

The Regional Prosecutor’s Office in Poznań, however, stated that when Giertych learned that there were no obstacles on the part of doctors to be questioned, he started “simulating a lack of awareness”. The prosecutor’s experts decided that Giertych should remain in the hospital.

The prosecutor’s spokeswoman, Anna Marszałek, stated that the investigators had applied a bail against Giertych following the doctors’ opinion, according to which his health condition precluded the use of preventive isolation measures in his case.

The court did not agree to pre-trial detention

In addition, Prosecutor Motawski informed on Saturday that after carrying out the trial proceedings with all 12 detained persons, the investigators filed a motion for the temporary arrest of five of them: Ryszard Krauze, Sebastian J., Piotr Ś., Piotr W. and Michał Ś.

Same day in the evening the Poznań district court did not accept the prosecutor’s office’s requests for temporary arrest of these people. On Sunday, the spokeswoman of the Poznań prosecutor’s office, Anna Marszałek, announced that The regional prosecutor’s office will appeal against Saturday’s court decision.

The remaining suspects, i.e. Tomasz Sz., Tomasz B., Andrzej P., Wojciech C., Andrzej P. and Bartosz P., were subject to preventive measures in the form of police supervision and property sureties, as well as a ban on leaving the country, as well as a ban on contacting other suspects.
