Prosecutor: Viggo Kristiansen is to be jailed for ten months for assault and intimidating behavior

– The assaults occurred repeatedly over a longer period of time. And it is aggravating that the behavior towards the neighboring woman induced fear and that it persisted after it was discovered, said state attorney Andreas Schei in his proceedings at the Borgarting Court of Appeal.

It concerns several sexual assaults against a girl who was seven or eight years old when the assaults were committed. Kristiansen also admitted to stepping onto a nearby woman’s porch several times and watching her, most often as she went to bed.

Legally established

The matters were legally resolved in 2001 and 2002 and predate the Baneheia case. Since Viggo Kristiansen must be acquitted of the Baneheia matters, the court must mete out punishment for the other prosecution matters. He served nearly 21 years after the Baneheia verdict. In any case, the sentence imposed by the court has long since been served.

The extenuating factor is that Viggo Kristiansen was young – 15 to 17 years old – when the abuses were committed.

Defendant: Eight months

However, the defender, lawyer Bjørn André Gulstad, stressed the enormous strain Kristiansen has been under and that this needs to be mitigated. Were it not for the Baneheia case, in which Kristiansen was wrongly convicted, the conditions under which the sentence must now be imposed would have looked almost like a footnote.

Gulstad came at a lower starting point than the prosecutor and suggested an eight-month prison sentence before stating that Viggo Kristiansen was considered as lenient as possible.

– These are issues that go back 26 and 24 years, emphasized defense attorney Bjørn Andre Gulstad commenting on the prosecution’s presentation to the Borgarting Court of Appeal on Tuesday.
