Proposed Changes to Mobilization Rules in Ukraine: Written Consent, Release from Service, and Involving the Unemployed

In Ukraine they want to change the rules of mobilization during martial law. Bill No. 10209 was registered in the Verkhovna Rada. Among other things, it is proposed to mobilize by written consent. Summon those who have a deferment or reservation, law enforcement officials. And release from service at one’s own request and attract the unemployed to work on infrastructure restoration.

By the author the draft law is a people’s deputy from the Servant of the People party, Gheorghe Mazurashu.

Mobilization by written consent

The draft law proposes to call up citizens for military service during mobilization, taking into account moral and volitional qualities and letter approval readiness to defend the country with arms in hand.

“The legislation allows for the forced mobilization of all citizens of military age and health status, except for those who have a deferment or are reserved. However, in my opinion, these are inadequate standards and extremely harmful. Therefore, this is not the first time that I have proposed changes that will force the TCC SP to look for and mobilize those who are ready to physically and morally defend the country, and not everyone in a row for the sake of numbers,” the author of the bill, Georgiy Mazurashu, commented to the TSN.ua website.

In his opinion, there is no point in mobilizing a citizen if he is not morally ready to defend the country.

“After all, as the volunteers note, because of such people, driven by threats and coercion, there are continuous problems in the army. They refuse to follow orders, leave their positions, flee, surrender,” says the people’s deputy.

Mobilization of police officers, prosecutors, and pensioners of the Ministry of Internal Affairs

The bill also proposes to mobilize those liable for military service who are entitled to a deferment or reserved with their consent and provided that they have at least two years of experience in government agencies. If they held positions that involved the use of firearms and have experience.

“Such changes, if adopted, will allow call up for military service representatives of security agencies, police officers, prosecutors, and the Security Service of Ukraine for a period of six months,” lawyer Marina Bekalo explained in a comment to the TSN.ua website.

According to Georgiy Mazurashu, this, in particular, concerns young retirees of law enforcement agencies. For example, pensioners of the Ministry of Internal Affairs.

“Who have dealt with weapons most of their lives, and now, being of military age and condition, for some reason are not called up for military service during mobilization,” the people’s deputy commented.

The bill provides for the possibility of attracting up to 30% of personnel law enforcement agencies into the ranks of the Armed Forces of Ukraine. Such changes will provide the possibility of rotation of military personnel called up during mobilization and serving for more than six months.

“For a period of up to six months on the legal basis of mobilization, including to ensure the rotation of mobilized people who serve without rotation for more than six months,” Georgiy Mazurashu said in a commentary to TSN.ua.

Release from military service at your own request

In addition, the bill offers the following categories the opportunity to be released from military service:

For military personnel conscript service in connection with the expiration of terms of service or at his own request, in case of violation of his rights as a military serviceman; Military personnel who serve as conscripts officers at his own request, in case of violation of his rights as a military serviceman; For military personnel serving by contractin case of official inconsistency or at his own request, in case of violation of his rights as a military serviceman.

“The specified categories of military personnel will be able to be released at their own request, if a report is submitted on the violation of their rights as military personnel and the failure to resolve the issues raised in it, corresponding to the powers of commanders (military officials), within seven days from the recorded day of filing the report or the absence of a response to the report ”, said Marina Bekalo.

The bill also provides for the right to conscript servicemen during mobilization to be released at their own request. If the mobilized person belongs to the category of citizens, according to Article 23 of the Law on Mobilization, they are not subject to conscription for military service during mobilization.

“In particular, this is important for persons with disabilities, full-time undergraduate and graduate students, teachers of educational institutions, reserved workers. They are not subject to mobilization, but this does not mean that they are not called up at all, there are many such cases. In addition, it is possible to obtain the status of a person with a disability or become a student or graduate student after the man has been mobilized,” Marina Bekalo noted to TSN.ua.

Involving the unemployed in restoration work

Unemployed citizens who are in the reserve and are not called up for military service or are not involved in the performance of mobilization duties for positions provided for by wartime states are proposed to be recruited restoration of infrastructure damaged as a result of hostilities or ensuring the work of other sectors of the economy.

“The point is that the unemployed (those who do not work at least 0.75 wages or are not engaged in entrepreneurial activities), who refuse to serve or fight, can be mobilized for work, including the restoration of infrastructure damaged by war,” he commented to the site TSN.ua Georgy Mazurashu.

Age limit for service

During martial law, they want to allow those liable for military service change the place of registrationhowever, within three days after this it will be necessary to notify the TCC of the joint venture about the relevant changes.

And also allow leave one’s place of residence for a period of up to seven days without notifying the head of the TCC SP.
