Offenbach over incidence of 350

The increase in positive corona tests continues, and the number of sick people in intensive care units is also growing. The restaurants failed with a lawsuit against their closure in the partial lockdown.

Berlin / Wiesbaden – In Hesse, further corona infections were detected in 1684. The total number of cases since the beginning of the pandemic rose to 61,055, according to data from the Robert Koch Institute (RKI) on Friday. A total of 836 deaths are associated with the pathogen. That is 15 more than the day before. The number of patients in intensive care units also increased slightly.

In Offenbach, the number of cases per 100,000 inhabitants reported within seven days rose to 368.4, as the municipality announced on Friday. 15 people are currently being treated in the hospital and more than 1,000 are in quarantine at home because they have tested positive or have had contact with a person who tested positive or are returning from a risk area. Values reported by municipalities themselves may differ from the figures from the Robert Koch Institute, since they pass on the data with a time delay.

According to the figures in the intensive care register of the German Interdisciplinary Association for Intensive Care and Emergency Medicine (DIVI), 278 corona patients were recently in intensive care units across Hesse (as of Friday 12.15 p.m. – previous day: 275). That corresponded to 16 percent of all occupied intensive care beds. A total of 83.5 percent of the intensive care beds in Hesse are occupied. 154 of the Covid-19 patients were ventilated.

According to a decision by the Administrative Court in Kassel (VGH), Hessian restaurants are only allowed to offer pick-up or delivery services due to the corona restrictions. An urgent motion against the provisions that have been in force for four weeks since November 2 has been rejected, the court said.

A landlady from Rüsselsheim essentially justified her application by stating that it was an unjustifiable interference with her fundamental rights and that the closure was disproportionate. The court did not follow this. According to a statement from the VGH, the Senate continues to adhere to its case law that the authorization basis contained in the current Infection Protection Act is sufficient for the legislator.

The restrictions are likely to be proportionate. The Robert Koch Institute was unable to assign a significant number of new infections to the restaurant environment. However, it should not be concluded from this that there is no clear risk of infection there. The very high number of cases in which the routes of infection can no longer be traced speak against this. The ordered measure to protect the population and the functionality of the health system is reasonable. In Hesse, due to the partial lockdown, restaurants are only allowed to offer food and drinks for collection or delivery until November 30th.
