NRW: Corona rules extended until April 26th and expanded by two points

The corona rules in NRW have been extended again and some aspects have been added. We’ll reveal what’s new in the Corona Protection Ordinance until April 26th.

Corona rules in NRW: Corona protection regulation extended to April 26th

The extension of the Corona Protection Ordinance in North Rhine-Westphalia is overshadowed by another important change, which, however, affects all of Germany. In the week from April 19, the federal government wants to change the Infection Protection Act in such a way * that certain rules must be implemented in cities and districts of all federal states – such as curfews from an incidence of 100 and school closings from an incidence of 200 on three days in a row .

Regardless of this, Federal Health Minister Jens Spahn (CDU) appealed to the federal states on Thursday (April 15) not to wait until the Infection Protection Act is changed, but to tighten their corona courses independently in advance.

Corona rules at schools in NRW are stricter than prescribed by the federal government in the Infection Protection Act

At least as far as the Corona regulation for schools in North Rhine-Westphalia * is concerned, this appeal has been heard. NRW Education Minister Yvonne Gebauer (FDP) announced on Wednesday (April 14) that she would take a more cautious path through the corona pandemic at schools in North Rhine-Westphalia than provided for in the planned, new Infection Protection Act.

Two corona tests per week should be mandatory for all students regardless of the incidence. In the planned federal law, this will only be necessary from an incidence of 100 or more. And: From an incidence of 100, NRW sends its students to alternate classes. In principle, full face-to-face teaching in cities with incidences below 200 is possible under federal law.

Corona rules in NRW: Two new sections in the current Corona Protection Ordinance

In addition to the regulations for schools in North Rhine-Westphalia, there are also innovations in the Corona Protection Ordinance of North Rhine-Westphalia. One of them concerns the plan to allow openings in eight model municipalities in North Rhine-Westphalia *. This aspect has now been anchored in the new paragraph 4c under the keyword “model projects”.

The state recently selected 14 districts and cities in which extensive openings are possible with the help of corona tests, vaccinations and digital solutions. Namely in: Ahaus, District of Coesfeld, District of Warendorf, Münster, Mönchengladbach, District of Paderborn and District of Soest from April 19th. From April 26th in the Düren district as well as in Essen, Hamm, Cologne, Krefeld, Lennestadt, Siegen and the Hochsauerlandkreis.

Condition for Corona model projects in NRW in the new Corona Protection Ordinance

In the current Corona Protection Ordinance of the State of North Rhine-Westphalia It is now stipulated that the municipalities are only allowed to start their Corona projects, so the 7-day incidence is no more than 100. The projects are also to be stopped if the incidence in a municipality has exceeded 100 for seven days in a row.

Cologne is one of the NRW model municipalities that will be allowed to open from April 26th – if the corona incidence plays along.

But there are – as always – exceptions. If a city or a district can prove that the incidence above 100 is not related to the model project, it should be continued for the time being.

Corona model projects in NRW are on shaky feet

Curious: Even before the model projects with far-reaching openings in public life in North Rhine-Westphalia start, there is only one participating district that is below the incidence of 100: the Coesfeld district (as of April 16). Hamm even has an incidence of 167, Cologne 162 and Mönchengladbach 145.

In the other participating districts and cities, too, the current incidences (as of April 16) are too high for the model project:

  • Düren, 162
  • Warendorf, 142
  • Essen, 135
  • District of Borken (with the city of Ahaus): 134
  • Hochsauerlandkreis, 127
  • Paderborn, 126
  • Münster, 105
  • Soest, 103

Münster, Ahaus, Mönchengladbach, the Paderborn district and the Coesfeld district have already announced that the start of the model project will be postponed.

In addition to the new paragraph 4c, the NRW state government has made a change in paragraph 10, paragraph 1, point 2 of the Corona Protection Ordinance. There it is about the operation of leisure and amusement facilities.

NRW: New Corona rules prohibit climbing parks, mini golf courses and high ropes courses.

The paragraph now explicitly states the ban on the operation of miniature golf courses, high ropes courses and climbing parks. Previously, there was only talk of a ban on “amusement parks, indoor playgrounds and similar facilities for leisure activities (inside and outside)” (read more Corona news from NRW * at RUHR24 here).

The question of how this passage works legally will be interesting. In North Rhine-Westphalia there have so far been two judgments on the operation of high ropes courses that found the opposite. While a chamber of the Düsseldorf Administrative Court considered a high ropes course as a leisure facility and banned its operation, another chamber of the same court saw a high ropes course as a sports facility – and thus as permitted in the sense of the Corona Protection Ordinance. *RUHR24 is part of the editorial network of IPPEN.MEDIA.
